It does matter if the two parties were dating and broke up, or of the complainant was dating another person. Sure, it doesn't matter what a woman was wearing. At this point, only feminists talk about what a woman was wearing as motive. At trial, you have to talk about what a woman was wearing in order to recreate the crime, not to say she was asking for it.

Nice guys rape, too.

The judge set up a series of straw men that had nothing to do with this case. A huge red flag.

This is a much more sane sentence for a case with no evidence than the 15+ years that the falsely convicted in the US receive.

How much evidence there is shouldn't matter for the length of the sentence. Either the court is convinced beyond reasonable doubt that the accused is guilty and gives him the full sentence or it isn't convinced and the accused has to go free.

They can't say that they give him a shorter sentence because they aren't convinced enough of his guilt and are afraid to make a misjudgement.

It just looks like a standard he said/ she said case, where the judge listened and believed her side. Does this actually change the legal landscape?

By itself no. But what is gradually happening in the courts is the same thing that has taken hold in college. The accuser is to believed, any evidence to the contrary will be discarded as some sort of rape induced trauma and confusion, and the defended will be in a position to have to prove his innocence beyond reasonable doubt.

In cases like this that will be virtually impossible to do, especially if any behavior to suggest that the sex was consensual is discarded because there is no normal rape behavior. "But we have several days worth of texts after the night saying she wants to get together again because she had a great time." Doesn't matter rape trauma.

As this judge repeats this yet again, the biggest myth is the feminist straw man that in first world countries we have a real problem with thinking women are "asking to be raped" because she wears suggestive clothing. No one thinks. No one. The only people who say this are feminists and white knights repeating the same falsehood over and over again.

Do you notice they can never point to a single case where a defense attorney used this in a court case? A single judge? A D.A.? A police officer? Imagine, "Ladies and gentlemen of the jury, yes my client attacked her in the park and forced sex upon her, but look at these sexy clothes, that means she obviously wanted to be raped, right?"

Urban Legends that won't go away:

  • tourist waking in bathtub full of ice and missing kidney
  • epidemic of people thinking a women is asking to be raped in first world countries

I've met few idiots who think this, but their morons and are not representive of anyone. Bony Rotten the porn actress ran around New York and nothing bad happened to her.

That Germany activists encouraged everyone to grope her, no just dress sexy, but encouraged strangers to feel her up. It didn't lead to her getting raped. She's fine.

Women are perfectly safe to dress however they want, perhaps safer then men.

I'm not a Canadian attorney, nor am I knowledgeable in Criminal procedure in Canada, but if there is any way to choose a jury and not a bench trial in front of this judge in Canada, then I would highly recommend a jury of his peers. Is there a beyond a reasonable doubt standard in Canada because I have no idea how any factfinder could be convinced beyond a reasonable doubt based on her testimony against his testimony where she sent him a text inviting him out for hot sex, was going to engage in a threesome, then when they break up, she reports it and it strongly appears that she was being treated for mental health issues based on her press release. Sounds like a fabricated rape allegation by a woman with a borderline personality disorder who felt abandoned by the accused after he broke up with her.

“In a lot of ways my life continues in shambles,” she said. She has changed her PhD subject from women in prison to sexual assault. That seems fitting.

Wonder if she was trying to find out what it is like for women in prison from a first hand experience and the plan backfired. Oh well she is making due with what she has got and all it cost her was the lively hood of an ex-boyfriend.
