A request for social security survivor's benefits for the kids will come first. Plenty of fathers are worth much more dead than they are for child support.

Tuscaloosa Sheriff Ron Abernathy, who oversees the jail and is named as a defendant, declined to comment and referred all calls to county attorney Robert Spence, who said he could not provide any information about the case but added that "the jail staff probably acted appropriately."

...of course they did...

Hospital records say Anderson was in "extreme condition" with a "massively distended" abdomen when he arrived. When attempts to resuscitate him in the emergency room failed, he was rushed to the OR."

Hopefully it will be. He made those kids, he is responsible for them. Child support is for the child, and both parents are responsible for it to a certain extent. A person can't just create a life and then walk away. They need to provide, and their money belongs more to their children than the to government.

The family of an Alabama man killed by a perforated ulcer while locked up for missing a child-support hearing has filed a federal suit alleging guards and medical staff at the jail ignored his screams of pain for a week.

Phillip David Anderson, 49, a father of four, was unable to keep down any food while he was held at the Tuscaloosa County Jail, the lawsuit charges.

He was arrested and transferred to the Tuscaloosa jail, where he vomited the first meal he ate and was unable to eat again or empty his bowels, the lawsuit says.

Reading some of the comments here makes me think posters are celebrating the evasion of child support obligations. As a family law attorney, I obtain child support orders for both mothers and fathers and it's never fun when the other parent is a deadbeat, regardless of gender. The people who suffer most are not the obligors but the children who need support. Is that what you're celebrating?

Where do you see anyone celebrating the evasion of child support? The problem with child support is that the amounts are absurd and unfair and that you have to pay the same amount even if you lose your job because of your "ability" to earn a certain amount. Its a messed up system. Child support shouldn't be needed when 50-50 custody is the standard (and it should be). Expenses like school fees, medical bills and sports fees should be split evenly.

If child support was about the children then the courts would base the support obligation on the needs of the child and not the income of the payor. Not to mention that there is absolutely zero accountability for the payee on how they spend the money. The state cares not for the child. They care about collecting money. That is why there are over 80,000 people who work for the Office of Child Support Enforcement making sure that the money is collected but zero government employees that make sure the child support monies are spent on the child. The myth that child support is about children needing support does not hold any water.

Accountability for the payee is a big one. Why can't child support be like an hsa. Both parents contribute proportionally and either can use it for qualified child expenses like medical or school bills.

That would be the logical thing to do. But the child support system is not run on logic. Approximately 12% of all jailed inmates (men) are there for inability to pay child support. $20 billion a year is transferred from men to women at the point of a gun through child support. It is big business.

So, the tragedy here is that those children will not get future payments from their dead father? All he is for them is a source of income for their other parent? He offers nothing other than money?

How about we don't incentivize people by attaching a dollar value to the amount of time they spend with their secondary care giver? How about we don't force payments on people who can't meet them? How about we do not send people to prison for not meeting the payments they can't afford? How about we don't allow the state to collect arrears on missed child support payments? How about we have mediators deal with child support instead of lawyers and courts? How about if we default to 50/50 custody?

He was arrested for contempt of court, not missing child support. He didn't care enough to even show up to discuss supporting his child.

His death is the exact reason BLM exists yet you reject them and their message. What is the point of this post?

Courts hold contempt hearings for missing child support payments without notifying the fathers. This is routine for them. I know many fathers who have been arrested without even knowing a court hearing was held.

Nothing about child support is legal or moral. It strips the rights of one parent under the guise of "the best interest of the child". It basically gives the state the freedom to abuse people. $20 billion dollars a year is transferred from men to women under the threat of incarceration. That is more than McDonald's, Nike, the NFL and many other large corporations make in a year. States profit mightily through child support. The child support industry is huge, ruthless, and evil.
