The law should just go ahead and be honest and define adult women as minors and the most proximate male as their guardian (in terms of liabilities, they can't actually do anything to restrict her actions).

Bad example, OP/TS. McCasland actually injected his stripper-addict girlfriend with three hits of heroin and three of cocaine with his own hand, making that murder charge reasonably justifiable.

So he's charged with murder because she's a drug addict?

I can see being charged with something, but life in prison without the possibility of parole?

Had the genders been reversed, she might have gotten reckless endangerment, or something much less severe.

There's no denying that the severity of the punishment is due to sexism.

Addicts inject each other though. If she wasn't an addict then the situation would have been different. It's beyond stupid locking addicts up for doing something virtually all addicts do.

With the logic employed here, every time an addict injects another it's attempted murder. They are not medical professionals and most don't have testing kits to test purity, so every time is indeed Russian roulette. Or maybe they are just lost individuals with addiction issues? Maybe injecting each other therefore isn't de facto attempted murder and in fact not murder when it goes horribly wrong?

Even people with near-perfect childhoods make stupid mistakes. Like driving slightly over the limit just once, or buying drink for your underage self and friends. With enough bad luck pretty much all the good people here could be behind bars for life. It's just easier to judge others than ourselves.

My bet would be that the $5M or so in legal/appeal/incarceration costs for this dude would actually improve/save a lot of lives if it was spent on education and safety measures. I really have no idea what locking him up until 2070 or whenever he dies is going to accomplish and the punishment does not fit the CRIME, even if the outcome was horrific.

And let's face it, if the tables were turned he would still be the - dead - demon and she would have received a relatively light sentence because only the backgrounds of females are taken into account with sentencing, because only men are autonomous individuals.

The way the murder 2 statute in Louisiana is written, to prove murder 2, the state has to prove action, intent to the act, and proximate cause between the act and the death. No need for intent to kill.

But it is a factor. That's the point.

Compare, for example, the drugs business with the sex business (not an exact analogy), but observe how differently they're treated. There's moves in Europe to decriminalise women entirely and shift all prosecution onto the men with regard to prostitution.

Nice use of stereotypes, but women do often buy drugs on their own. Women user drugs at the same rate men do, but are far less likely to be searched, so they don't get caught with them.
