Why is this a problem? It's only a problem if you care about your statistic being factually true.

If all you want to do is perpetuate the belief that women are victims (and thus we need a never ending cycle of legislation to help them), it's fine.

Yeah, there couldn't possibly be any confirmation bias in a sexual assault survey.

The survey had a response rate of 19.3 percent, with a total of 150,072 students participating. Graduate/professional students responded at a higher rate than undergraduates (23.2% for graduate/professional and 17.4% for undergraduates). Females (22.9%) responded at a higher rate than males (15.6%). To generate estimates for the student population, the data were weighted to adjust for this differential non-response. Response rates across the IHEs (Figure E-1) ranged from a low of seven percent to a high of 53 percent.

The survey question for how many people have been raped or sexually assaulted should be, "have you been raped or sexually assaulted?" Their method of asking about more seemingly minor behavior, that the survey participant does not realize you will count as assault/rape, is a transparent ploy to pad the numbers.

Nowhere does it say drunk kissing. The qualifier is " passed out, asleep or incapacitated".

To be fair, it's not calling all drunk kissing sexual assault. It's saying kissing that happened while you were incapacitated due to drugs or alcohol is assault. Being incapacitated means that you're too weak to move.

What's more, I don't know why we're acting like unwanted kissing isn't sexual assault. Kissing is sexual in nature. If I don't want your tongue in my mouth, it's violating me for you to put it there. Of course it's not as traumatic as other forms of sexual assault, but it's still sexual assault. You could even give me an STD through kissing.

That being said, I do wish this survey was conducted without the affirmative-consent language, or acknowledged that consent doesn't need to be a verbal check-in every 3 minutes.
