"Subsection (1) does not preclude any law, program or activity that has as its object the amelioration of conditions of disadvantaged individuals or groups including those that are disadvantaged because of race, national or ethnic origin, colour, religion, sex, age or mental or physical disability."

Basically we have it codified that you can discriminate against white men with impunity.

It looks like the municipality and the province are involved in funding this studio as well (maybe even the fed govt). Any production utilizing the studio is getting tax breaks. Again, I'm not clear on the law, but if various levels of govt are involved in funding this facility and the studio is discriminating against men, wouldn't that make this scenario even more egregious?

I would think so.

And really - is this how women directors want to get hired? Not because they might be the best "man" for the job, but because the production is getting her at a major discount? And why are so many feminists on Twitter lauding this when it's just playing into what they say they abhor; their narrative that society treats women like commodities that can be bought and that can't compete with men on an even playing field?

The feminist motto is "if it feels right, it is right." Logical consistency doesn't enter it. When something is seen to harm men, it "feels right" because they believe (absurdly) that they are "punching up." They don't even really seem to care about the long term effects on women. They just want to harm men ("the oppressor") as much as possible.

If they were sued, they would have to prove that Subsection (1) applies to this scenario, would they not? The subsection itself does not protect them from facing litigation or a hearing before the CHRT, does it?

Yes, it seems like it would be in violation of the Canadian Charter of Rights and Freedoms. If productions are being denied the same credit because they have a male director instead of a female one, is that not breaking the law?

Clearly less women want to be directors, leading to less female directors. It's not like Canada of all places is just refusing to hire qualified women.

Absolutely. Women are over represented in other aspects of the film industry, like make up and wardrobe. No one is agitating to get more dudes into those positions. And as far as film as an industry goes, most women choose to pursue acting over film work. No one in Canada is preventing women from pursuing directing careers. Women choose to pursue careers other than technical crew work or directing. There is no nefarious campaign to keep women out of those fields in the film industry.

How is this beneficial to the art of filmmaking? As you've stated, instead of it being a meritocracy where the best director (male or female) is hired to produce the best work, instead a scenario is created that incentivizes hiring a director not based on her work but based instead on the fact that she has a vagina.

From the article:

TriBros also announced plans to put an end to gender inequality in North American film and television production by launching an incentive program to encourage the hiring of women in leading creative positions. Mr. Apostolopoulos announced TriBro will cut studio fees in half for any female-helmed productions at its existing studio in Toronto, and at its future studio in Pickering.

He noted only seven per cent of the largest 250 feature films of 2014 were directed by women.

Pickering-Scarborough East and Minister Responsible for Women’s Issues, Tracy MacCharles, said despite women making up more than half of the population, inequality still exists, and this program will encourage female directors and showrunners.

“I think this is just incredible leadership,” said Ms. MacCharles.

Essentially, what this means is that productions with male directors will penalized by the studio by being forced to pay all fees, while productions that hire female directors will be rewarded by having their fees cut in half.

Yeah. What you'd do is get them listed as being co-producers, or get an intern listed as the producer while the actual producer is formally listed as the assistant producer.
