This is gender neutral just as if the legal definition of "stealing" was "anybody with a skin tone darker than X who takes the property of somebody else without their consent" isn't racist.

Technically it's not targeting black people, because white people can have a dark skin tone. And technically women aren't deliberately excluded from being perpetrators of rape, because they can use objects.

This isn't the worst definition I've seen. It's clearly still suffering from a twinge of the only-men-rape mentality, but it looks like they tried to be all inclusive. I think I'd rewrite it to say "Unlawful sexual intercourse, with or without penetration, without the consent of the victim".

If they're going to bother being so descriptive about forced penetration, they had might as well include "made to penetrate" to be more balanced.

I think the term sexual assault applies equally btw. It probably makes more sense to use that term for both male and female perpetrators IMO.

This is a bit better than a lot of other definitions out there. Instead of emphasizing gender as the primary factor, they emphasize penetration. Now, penetration in of itself isn't a gender specific term, since you could have a woman penetrate another woman or man with an object or her fingers, but it is very much gendered in the sense that it specifically seeks to prioritize the female sex organ over the man's.

Biology made it so that a man has the tool to penetrate and the woman has the tool to be penetrated. That is how they have sex. So, in a sense, that definition still kind of misses the mark on what should or shouldn't be rape by basing it's definition on penetration alone. A woman who forces herself on man, or who forces him to penetrate her through threats/force, should still be defined as a woman raping a man, even if he is the one doing the penetrating.

Rape is crime because it is forcing sexual intercourse on someone against their will. It is sex against their consent, by force, threat or coercion. A woman could still rape a guy without penetrating him. The fact that his genitals are external and a woman's are internal shouldn't be the defining factor in what is or isn't rape.

I am not sure what you want to discuss here. Ever since teach men not rape, there has been a push to change all men into what feminist want men to be more about.
