Criminality is a Social Construction. Our laws and the relative criminality of their violation are defined by those in power, or those who influence those in power. Over time these values become institutionalized and unquestioned.

Historically men have functioned more prominently in the public domain. The actions of men are thus more of a threat to those in power; either through direct confrontation or through affecting public order. We punish a thief severely as he/she affects public order, but a gossip or a rumor monger is essentially immune from sanction. Rumor mongering can cause untold pain and suffering to an individual, yet we don't even have the vocabulary to fully discuss it or the mechanisms to curb it.

200+yrs ago when we lived in village communities, a gossip was a threat to public order. The ducking stool and muzzle was the order of the day.

The liberal left decry social contructivism when it disadvantages them, yet are involved in the biggest contructivism fest since Moses came down from the mountain. The fact that the relative criminality of rape is probably originally a massive social construction by dominant males, is conveniently absent from their thinking.

So are women just as criminal as men? It depends on how you define criminality and if you can manipulate the public to your view.

I think it's an open question given the insane amount of bias in reporting of the data. How many people would have predicted men are raped as often as women ten years ago? I wouldn't have, and I was aware of the NVAWS saying that men were raped about 1/3 the rate of women, and knew the figure was likely higher still.

they are less likely to be stopped; once stopped, they are less likely to be arrested; once arrested they are less likely to be charged; once charged, they are less likely to be convicted

And there are other levels. Their crimes are less likely to be seen as crimes for example.

I bring this up all the time as well, as do others. If you look at when couples commit crimes together you will also see that often times a plea deal will be given to the woman in order to nail the man even harder.

I can't remember the name of who did it (someone else might know off of memory), but there was a case where a couple got together and did some terrible stuff. The woman helped keep blinds open so that her SO could peep through the windows even though she was really young, and that eventually led to more. They basically drugged and kidnapped her in order to have sex with her and the drugs they gave her ended up killing her. They worked to clean up the scene a bit and then lied about what happened. Eventually they started kidnapping people off the street together, torturing these people, raping them, and eventually killing them. They even hacked up the bodies in order to hide them. Eventually the woman got a plea deal which was basically a slap on the wrist in order to nail him extremely hard even though she was involved in all aspects of it. They basically treated her as a victim of his ideas. She's living in the Bahamas somewhere now I believe. I wish I could remember the name. I originally saw it on the ID channel.

While I think women probably make up a larger percentage of criminals than people currently believe, I'm inclined to believe that overall it's not quite 50-50. Or, if it is 50-50 overall, women are more inclined to commit small crimes and men larger ones.
You know how they talk about the difference between male traders and female traders? Men bet big, win and lose big. Women bet small, win and lose small. They tend to come out about even overall. This is all about risk. Men tend to take larger risks. That means more serious crimes. Women probably take a lot of smaller risks. I wouldn't be surprised if drug users were disproportionately female.

How does one define criminal?

What is the basis for making something a crime? If it's simply the contravening of whatever happens to be in the law books, then that could probably be calculated.

If a crime should be something that causes deliberate or callous harm to another, then women are probably more criminal than men.

Take Paternity Fraud. It's a crime that only women can commit and is supremely damaging to at least 3 peoples lives (the child, the duped father and the real father) and is one of the worst and most damaging betrayals imaginable. It's much worse than infidelity, DV or rape - yet it carries the sentence of .... nothing.

Intimate betrayal and public humiliation - also damaging (especially to children and teens) - not even on the books.

I'm not saying that telling a schoolyard full of peers that your daughter wet the bed till they were 8 should be a criminal offense, but it should be recognized as what it is. And Paternity Fraud should absolutely be on the books.

I doubt that, even with equal judical treatment, women would commit as much crime as men, simply because there is not that much inclination to, due to having much better support, more safety nets and so on.

This is one of the issues where the double speak of feminism comes out really clear.

Both criminals and high end business are about taking risks. We should see the same ratios of female criminals as female Business leaders. Women are either taking the risks in which case the stupid ones go to prison and the smart one make millions or women are not taking the risks and deserve neither millions of dollars or to spend time in prison.

I for one am not convinced that women commit crimes at the same rate men do, but neither do they take the risks needed to make millions of dollars.

I agree with most of what people of the "Men's Rights" movement have to say, I just think there should be a different name for it. Because it's less a fight for our rights, more than it is a sort of check and balance for societies unwavering bias towards females over males.

For many classes of crime I believe women are just as capable as men. Also like many have said there are crimes that women do that don't get classified as such. Some old laws that covered those behaviors are considered 'uncivilized' by today's standards for various reasons.

But I do believe there is selective pressure for men to commit certain types of crime. As a woman you basically just have to be pretty to be a desirable mate, but a man mostly needs to be successful. So for men there's sort of a social pressure to take more risks than women. The risky behavior can end up being socially positive(explorers, doing dangerous jobs, starting a business, etc) but can also be socially negative(drug dealer, hacker, thief).

In certain respects you can't have the positive without the negative. The same base drives that give you a drug czar are the ones that give you a Steve Jobs or Bill Gates. Women absolutely can have these drives, but there's just less social pressure on them for it.

It's well known that women receive a sentencing discount after being convicted of a crime.

I'd say 'commonly believed' rather than 'well known'. Making a perfect comparison of crime details where the only difference is gender strikes me as difficult, if not impossible. So reversing the genders for any given crime is little more than a thought experiment. An interesting thought experiment, certainly, but results of it seem to be touted as fact fairly often.

If we take that same 60% figure, approximate it as 1:2 and assume it applies at every stage in the process, we get 1:16 which is approximately the ratio of females to males in prison.

Yay math. At 50% the numbers check out. But given such small numbers, approximating 60% to 1:2 makes a huge difference (from the more accurate ~1:8 to 1:16). However, that makes things a little less tidy because one can use that discrepancy to muddy the waters and/or derail.
