Adultery generally won’t factor into placement at all, even in ‘fault’ divorce states. Only thing adultery generally factors into is potential alimony payments and possibly marital assets.

Edit: unless you can prove the affair has changed their fitness as a parent. The act in itself does not change the fitness.

If you’re in a no fault state adultery doesn’t really factor into custody or divorce.

Yeah bro, adultery dont mean shit as far as custody goes. Ask my attorney last month. It's all good though. As long as you've been a hands on parent, you'll get 50/50 most likely. I sure hope so... that's what I'm shooting for. Good luck friend.

Start keeping a journal, and texts. Neither is admissible unless she admits to it. So basically a good lawyer will ask her why she said “whatever” on this date when she went out. The explanation doesn’t matter, just admitting it happens means the rest of it can be entered into court as evidence. Make sure you record more then just when she leaves in the journal, record helping with homework record when you take them to activities record babysitters, record work hours. The point is it’s a journal about your life, her leaving just happens to be in there. Then with enough ppl supporting you (yes we saw him at practice with the kids) that can be put in as evidence....rinse and repeat. Don’t fight fair, slow and steady and indirect. In a straight fight you lose.

No one cares who cheated. The courts want each parent to have equal parenting responsibilities. Unless you can prove your ex is a drug addict that puts your child in danger 100% of the time, you’ll start at 50/50.
