Honestly the easy answer here is always lawyer up and while that's true your situation reminds me of my own (no the cheating or anything). First unless he's actually abusive and its well documented courts don't want to remove a parent from the equation, their mindset is to do whatever is best for the kids. A good lawyer will avail him of these fears and put a temporary custody agreement in ASAP. I would have advised him not to move out of the family home as it sets a bad precedent regarding time spent with the kids, but it looks like that ship has sailed. Have him request time with the kids and save all documents (texts, emails etc) of her saying no and why.

My sister was an absolute rock for me during my divorce and well after. I had other support but none better than her. Take him out, try to have fun, listen to him and understand. Under no circumstances did my sister ever say to me "you need to get over her" or "move on". That shit will take time and saying that is hurtful because its not something you can turn off no matter how horrible the ex is or might be. This is a shitty space he's in, but it will pass and you have to assure him of that but never push it. Invite him out with you and your friends or over to watch a movie and if he needs to vent and call her names etc then so be it. A lot of people can get tired of the 'trashing of the ex' and tell him to move on, but its really part of the process and he's looking for validation. Just be there for him, he'll be lonely, he will be in his own head when support is not around so if you're at work or doing something without him and he comes to mind then text him and tell him and it will mean a lot.

What's coming will most likely be the hardest thing he will have to endure and it is very akin to a death of someone close to him because it basically is. People don't realize that when you get a divorce and you have kids/been together for a long time you don't just divorce her/him you're divorcing your entire life and have to start over, everything in his life will be affected in some way and that's a heavy burden. -A long, painful court battle where your brother loses thousands in legal fees and which he has no chance of winning.

-Your brother only getting to see his kids 4 days a month, and having his wallet torn out through his asshole. Your brother loses his house, half of everything else he owns, and must pay her 25% of his money in child support and probably a massive amount of alimony as well.

I would tell him to see a psychologist because he will be at very high risk for suicide.

If there are claims of abuse on kids the first thing will be asked are there any police or medical reports to back this up? If not why wasn’t anything done at the time by the mother. The oldest child maybe questioned if it goes to a custody battle. I feel really sorry for your brother a mate spent 170k and two years (and months at a time not seeing the kids) defending himself of false accusations- ended up getting 50/50 but now suffers from depression and anxiety which he is trying to overcome. The ex just walked away when there was no proof without repercussions. Get him to document everything and get legal advice straight away- even though he was forced from the family home in a few weeks he will not be able to return and can get the police to remove him.

This also happened to me during my first divorce. BS claims from her that she was encouraged to make by her lawyer. The lawyer was her cousin and has hated me for 20+ years.

I had a great lawyer, though, and the claims were dismissed with prejudice.

Your brother needs a great lawyer.
