if she is ready to sign a post-nup get a LEGAL SEPARATION if available, its the same two signatures, its way better than a post-nup and very durable during divorce

Depends.

We signed one. We were splitting and agreed on all the finance and basic custody stuff. I insisted we write it down before I moved out. Good thing.

Because spouse immediately claimed they never agreed to any of it. Of course they did.

Oh wait, except it is all in writing and they were a lawyer so they couldn't pretend they didn't understand what they were signing.

We almost got to trial. I believe having that document helped avoid trial and got them to finally sign off on everything we agreed to.

My attorney absolutely thought having that document was a very good thing. Our final decree matched it exactly.

Prenups become less durable the longer the marriage lasts.

You also can't use prenups to get out of child support.

If you need a prenup, you need to take a deeper look at your relationship because you're negotiating genuine desire.

It's my understanding that they aren't very effective, but it's going to greatly depend on the situation in which you're attempting to apply it.
