You don’t necessarily need a lawyer. Hiring one can be a slippery slope. The lawyer will require a retainer. Im guessing $2,500 minimum. Then of course drafting and filing documents. All of which you can do for free.

1) identify your court house. Go on their website or call, see if they have a legal self help department. Most do.

2) Learn how to file your own motions and petitions. Familiarize yourself with the language and paperwork gymnastics.

3) File a motion to modify parenting agreement. Assuming you have one. This will be what the judge will use to modify the custody.

4) Dont write it up as my daughter said she wants to be with her dad more. Yes, thats great, but show things like, (a) In the best interests of the child, I want to maximize my time with her to build, bond and nurture father/daughter relationship. (b) Minor child enjoy spending time with her father, but also has a very hard time when parenting time is over as she feels she is not given enough time with her father.

You dont have to use those words exactly, but just keep word smithing until you get a nice write-up.

Dont try and negotiate with the ex, as she knows she will loose money when it comes to overnights.

Educate yourself and keep fighting. Only get a lawyer if you have $3-5$K that you’re willing to loose. Lawyers are not your friend. They sell you scenarios and possible outcomes of which you will choose. Keep at bruh! 💪👏🙌.

As sad as it is, the mother will not allow 50/50 because of child support payment risk.

The courts in some states wont allow 50/50 unless both parents agree and are both able, fit and willing. The state gets reimbursements from Title-IV D (federal money) for collecting and pushing child support payments through the system.

Some judges get their judicial retirement fund via the state agency that collects child support. You see where I am going with this..... It's a legal RICO organization that all benefits from child support.

Your options are:

1) Get with the mother to agree to 50/50 and keep the same child support payment.

2) Hire a lawyer and spend your savings against a racket system that's built to force you into conflict for the benefit of financial incentives built by the federal government and local states.

I have no idea but my guess is no when it’s comes to custody. But you might be able to consult a lawyer for a one time visit, or pro bona lawyer. I wonder if you could have a document drawn up and notarized by all parties for a change like that. Avoid the courts. Idk. The issue is legally that would affect support payments if she is splitting time equally, unless that’s not an issue.

It may be in your best interest to get your daughter into therapy. A therapist's recommendation included in the petition would be worth every penny. Take your time, play the long game, do your research and plan every move. Don't rush this, give it a few months at least. If a judge rules against you it could severely diminish your chances of getting 50/50 in the future.

Also, be discreet. You can tell your ex therapy is to help your daughter process the divorce and the changes in her life (which it is), but the 50/50 recommendation would huge.

Some things to consider.

Do you live in the same school district? If not have you planned childcare and transportation?

Do you have appropriate bedding and bedroom for your child?

Go in fully loaded with all your bases covered. Go in with a therapist's recommendation and your ex really won't have a leg to stand on.

My kid too and I'm breaking. I've also been fighting like hell and had no luck getting it to 50/50.
