My stbxw did this filed charges 11 months after the fact of an argument we had i threw a kids fisher price 2 ounce toy hammer against the wall and it bounced onto her foot left a little bruise it-was wrong of me for throwing it but it was an accident that it hit her foot ..whatever and she did the restraining order thing they approved it and when we went to court finally our permanent judge threw it out and none of it mattered and i won in the end . It did get me out of my house tho . It was an evil tactic was all planned like you are planning. But in the end the judge really dislikes her it is very obvious that this is a regular tactic and is not tolerated anymore. So your best bet is to fire her up get her to do something stupid like spit on you or just push you then file dv charges immediately when it happens and then file divorce. That year prior allegations help but will not stick and may backfire lie it did to my stbx cunt. Its a brutal brutal journey just a heads up. Im a year into it i got joint physical custody pay zero support and getting my house money any day now in the end i won what was fair but its been a fucked fucked year. I lost all my shit in house like memorabilia ,snowboard gear ,collections of stuff like albums dvds and got zero kids stuff like toys i spent thousands on and not to mention any furniture or kitchen stuff. I had to start from zero at 45 years old . That sucks. But the gratification of a big fat fuck you to that bitch is priceless.

Would there be a benefit to battery charges if they were actually filed? Yes. But they haven't been filed.

Either file them, or not. Doing so this late without corrabating evidence is going to be tough, imo. Can't speak to the yes/no question regarding divorce since you seem unwilling to address that.

I don't think you will get a restraining order with an evidence that old. However, that evidence will help you if ur stbx files any marital tort motion alleging any physical abuse and harassment. You have given very little details otherwise. If u earn substantially more than your stbx & don't think ur stbx deserves more alimony/child-support, u could get a low paying job and wait 6 months before filing. Alimony & child support are the biggest pains post divorce and particularly when the ex uses that money on her boyfriend and not on kids. Do the right thing though. Cheating her now or hiding assets will open up chances for future litigation, since there is no statute of limitations & judges are eager to re-open cases!
