Stbx has called the cops twice for false domestic violence charges. I have not been charged with anything , but asked to leave and I was able to return the next day. The 2nd time the officer started off yelling at me , he told me I could get arrested but he wasn't arresting me . He told me to make plans to move out . I didn't move out but stayed with my brother for 2 nights now. I've texted my stbx multiple times asking when I can pick my son up because I want to see him . No response . Today my lawyer advised me to stop at the police station let them know I plan to return home and have no intensions of talking to her just being there for my son. When I talked to police they advised me not to go home to avoid jail. Obviously that would start me off with an uphill battle . Im very afraid of this . The last time I recorded the whole interaction and the officer did not want to hear it . I would like to see my son and understand time away from my house could be damaging financially and in my custody case but so can a criminal charge and a restraining order . She has been served but hasn't been filed with the courts until tomorrow. Should I go home today or wait until a agreement is established ? I know none of you are lawyers but appreciate your experiences . Thanks in advance
