Probably not. Have they been commingled? The very best you're looking at a 50% split in appreciation of the asset from when you were married.

Ugh, that's tough. Can you get an agreement from her on what the value was? If you have to fight it you may be out of luck

They may not be legally obligated to keep them 7 years but you don’t know until you ask (and be sure to mention you need the statements to support a separate property claim in a divorce proceeding).

I’m going through divorce right now and was surprisingly able to get monthly statements from both UBS and Morgan Stanley going back to 2004.

Because (in Texas) any capital gains or income earned on those assets are community property, I’ve had to hire a forensic accounting firm to trace every transaction going back 18 years.

That will cost about $30,000 is the estimate, for but for a strong separate property claim from a court-respected firm, on about $750,000 of (per-marital) after tax brokerage accounts?

Worth the time, money, and hassle.

If you go this route do NOT mention anything to your STBX. The only mention she should see is something about “plans to make separate property claims” in the filing.

I was sure to get a partition agreement to separate certain of our assets, and a child custody and conservatorship agreement in place first. She will find out details about my separate property claim later and she won’t like it.
