I don’t know the answer to that but if you are the higher earner, can you file in a different state?? I would. NJ is terrible to the one who makes more money Lots of alimony for a long time

It depends, and there are too many details to come to a conclusion here. You need to discuss your specific situation with a family law attorney. You should be looking into what it take to establish residency in that country. She can claim she was on vacay the entire time -- then what?

Does she have dual citizenship? How much of her possessions did she take with her? Is she paying utility bills in the new country? Does she have a driver's license in the new country? Has she established bank accounts there? That's the line of thinking.

This is definitely an attorney question since there's an international component to it. Usually there's a 6 month residency requirement to file in a new state. But, since NJ is both of your states the real question is the international travel that she took.

Sounds like she abandoned you. Are you in contact at all? Are there allowances in your state for that?
