So, update, she cancelled her student visa, waited for the divorce papers, packed three suitcases and left the country for good. Left mmenbehind with our 8 year old. I am not sure about the lawyer I have for this non standard case, but if anyone knows someone who has this expertise in Broward County, please let me know. This is a great chance of getting some custody. Thank you

Yes, that's what we did with the lawyer. Waiting for her to get served. Papers are on the way! Should come every day!

You know what I currently hate the most living with her under one roof before the divorce trials etc? The paranoia. I'm even paranoid posting here, thinking she might read some stuff. Other than that I'm just really sad about seeing my son trying to fix mommy and daddy together. Daddy sit here, mommy you here, let's ALL play that game. That's heartbreaking.

In my first meeting with my attorney, I brought evidence that my spouse was having an affair and who the AP is. She looked at what I had and shut that down fast: you are no longer going to talk about this.

I am to play nice and not come across as the jilted, scornful spouse who got cheated on. It will hurt me in the end, my attorney said, especially with custody.

What type of evidence do you have? The courts don't care if there's an affair unless it affects marital funds. If you bad mouth your wife, you can come across as the angry, bitter, unstable parent.

Be careful what you bring to court and if you need to, pick out the strongest evidence. The judge doesn't have time to look through everything you have. Show up to court in a suit, calm, smart, and level-headed.

If you want to hurt the spouse, do it the legal way with subpoenas, interrogatories, etc.

Mines was taking spy like espionage photos out the window with me holding our 30lb daughter in one hand claiming I was dangerously “dangling” her…. Never mind I can easily lift 200lbs with each hand.

It was like I was living with a mole.

The point is, does your evidence leave you looking like a despicable human being. I.e peep hole cameras or does it legitimately show her in ways that are detrimental to raising your kids.

Are you pro se? This is a question for your lawyer.

As a general matter in litigation you typically need to list and disclose the exhibits you intend to use for trial but it is typically a question of what procedure the court prefers.
