Service of process by mail is entirely appropriate. You get them in the mail, sign the acknowledgment, mail it back. Your acknowledgment then gets filed by the other side. This is normal, appropriate, professional.

Don‘t play service games. It will fail. If you don’t sign, here’s what will happen. The lawyer will hire either the U.S. Marshals or a private process server. They will find you, guaranteed, even if it takes weeks or months. When they see you they will hand you the papers — and even if you don’t “accept” them, in your presence they will place them on your doorstep, on your car, on your desk, at your feet. This is completed personal service of process. Your “acceptance“ is utterly irrelevant. Hell, there are stories of professional singers, who dodged service, being served process in person right before they went on stage — entirely legal, entirely appropriate.

And that is enough to effectuate personal service. More than enough. It doesn’t matter if you don’t hold out your hand. It matters not if you refuse to grasp the papers. The process server will complete a sworn declaration, saying the papers were delivered on X day at X time, in person. This sworn declaration will be more than enough proof of personal service. It will be akin to signing the acknowledgment referenced in the first paragraph.

And then your game is over. Personal service = the court has personal jurisdiction over your divorce, and over you. The courts are well-versed with process dodgers and no shows. Happens every day — as do bench warrants for arrest for failure to appear, failure to follow a specific order. I see this happen every. Single. Day. So, stop with this effort that will fail, and get serious about the reality of a California divorce.

Are you worried you'll have to sell to buy her out? Cause I got my house appraised recently and it came back lower than I paid for it. Might be a good time to get on, unless you think it will get worse before it gets better.

In my state, if you don't respond by a certain time, the judgement defaults against you. Typically your lawyer would accept service on your behalf. Do you not have a lawyer yet?
