My exwife said the exact same thing, for an 11 year marriage. She wanted alimony at 50% of my take home pay, plus full custody, my house, my car, etc. She tried to play the "too sick to work" card.

Mediation went nowhere, so I said, "See you at trial."

The judge ruled that there was no reason why my exwife wasn't working, so she awarded her $0 alimony. I got 50/50 custody, and I kept my house and my car. She got half of my 401k and that was it.

Took her 2 days to stop screaming.

And yes, my exwife's lawyer must be just like your STBXW's lawyer. Telling her exactly what she wants to hear.

Only thing she’s right about is the alimony for marriages after 10 years but that’s not a permanent thing nor is it guaranteed. There are caps to how long and how much she can get. Also she has to find a job and alimony is for any shortcomings where she can’t afford the basics(housing, food, clothing). If she was disabled then I can see her getting alimony for sure but that doesn’t seem to be the case.

She won’t get extra in alimony because your child is “disabled”. It’s the child support that may go up but if it’s for a counselor I’m guessing insurance is paying most for it and if you cover the kids insurance hopefully you probably won’t have to pay more than the mandated child support amount. Hopefully her attorney isn’t feeding her all of this.

My ex tried to ask for spousal maintenance for a marriage under 10 years when there was nothing wrong with her to work. She must’ve found out that she probably couldn’t get it and never pushed for it past the divorce response. If she did push for support I would’ve pushed for child support from her since I got custody.

So disabled child no.. the spousal support is based on your income and hers add together and cut in half.. you give her the difference... Depends on the county etc..sometimes its based on other things..and if its really necessary.. Spousal support has nothing to do with the kids. Child support depending on the area could be 500/kid or more depending on income difference as well. And the custody of the kids ie if she has them mainly it could be 500+each.. if you split 50/50 it could be less... Shed need to prove that your oldest is disabled.. which would mean she has major anxiety, depression, and probably some pther medical issues..

You'll be fine. I went through this same thing, had two kids in counseling she was running up there - married 20 years with three kids, didn't pay her shit in anything in the end. Texas is great.
