Trying to understand a few things around what to expect when you file.
a) if I file online (for cheap/free)
is it the same as using a lawyer? Meaning.. will my STBXW be sent some papers via mail (or email?)
does it count legally as the initial date that everything stops (more on that in a sec)?
in California, is mediation scheduled as part of this process to start the division of assets, alimony, etc?
b) same as above, but with lawyer. Obviously I assume more is handled for you by lawyer.. but roughly what is the cost, what happens? Typically.. I realize it may be different for everyone and depending on where you live.. I am in California.
Does the lawyer set up mediation.. or has to wait for STBXW to receive papers, then respond?
There is some sort of cooling off 6 month mandatory wait? Is that required.. or just a suggestion..but things can progress faster? Like.. if STBXW agrees.. can she sign stuff and get the ball rolling sooner.. or is it required by law to wait 6 months?
IF required to wait 6 months.. do all things still freeze?
What do I mean by freeze? Well.. what I mean is.. if I take on a 2nd job.. or my company issues me stock.. etc.. does ALL of that no longer affect that outcome? Would stock I accrue no longer be allowed to be split in half with her? Let's say I have 4 years of stock, I am 1 year in.. so 25% vested. It takes a year for divorce to be final. Does she still get half of the 50% (after that year longer).. or only half of 25% due to all things freezing once I file?
Thought I roughly think I have the answer to this.. how is alimony truly factored in? If I make 200K, she makes 90K a year... but where we live she could roughly afford to live on her own on her take home pay.. is the location of living factored in to what I would pay in alimony?
I did speak to a lawyer who calculated that based on my pay, her pay, and such, I would pay about $1200 a month. Though I have no clue for how long, she did say that in California it is roughly based on that my STBXW would have a certain amount of time to adjust to and make it on her own. Despite 20+ years of marriage, I was under the impression that because she works part time and makes good money (part time even), that it wouldn't be for like 10+ years of alimony pay. We have one daughter in HS still.. so child support would factor in of course.. but that's a couple years tops.
My biggest pain point is that I assumed, and have read here, and also the online alimony calculator.. seems to indicate I would pay my STBXW about $4K a month in alimony.. for a long time. Which I do not understand.. if I did that, her take home pay + alimony would give her MORE money than me after alimony payment. That makes no sense nor is it fair. I should not have to pay her enough so she can keep on working part time and have a great cushy life while I work full time (and then some) so that she can do that. I know I can have her work imputed as well.. but she has medical issues for many years that I suspect will be played on by her lawyers and though no guarantee.. I could see a judge ruling in her favor to only have to work part time. I would hope that would also reduce what alimony I might have to owe her.. e.g. "You can work part time.. but we're not going to penalize your Ex and make him pay you more to do so.. you are free to work full time and make more money than he does.. "
Struggling with all this.. because I am unsure of what to do at this point. I am not quite ready to file.. I want to make sure I have a pretty good idea of what to expect.. what I need to pay, etc.
