95% of divorces are settled before trial. However, mediation and sending offers back and forth is a waste of money, brains and time without a trial date set. Divorce is all about incentives. Even if you have no intention of going to trial, the fear, uncertainty and doubt of a stranger in robes making life decisions is usually enough for the woman to be rational long enough to come to an agreement. Even if you can't come to an agreement during mediation, it's a long walk up the courthouse steps. You'd be surprised at the number of 11th hour agreements that are made outside of the courtroom.

She gave you a response. It was no. Aim for trial as quickly as you can get there to minimize attorney fees on meaningless back and forth. Expect a settlement on the courthouse steps.

I also did the same thing. No child support just spousal support. There was no response. I had to wait for 2 months for a judge to order twice the amount that I offered or 5.2k a month. No end date. I still get to pay her medical, car insurance, and her cell phone. Temp support didn't matter. It's easier for them to delay knowing they can just exist for free. 1 year in and the only thing that has been accomplished is the discovery she had to be subpoenaed to get her docs) and the amount I have to pay (that took 10 months. The duration and all other assets have yet to be determined. My case my be different as I have been ordered to pay her lawyer over 20k, so they have to use it all up - again, I mean now it's free money for the lawyer to exist right?

Hmmmm. I'll share my experience. I always thought lawyers were also negotiators. Like, maybe negotiating is taught in law school or something. There really is an art to it. We have people in our government who negotiate nuclear bomb treaties with North Korea. Geez, it seems like a divorce should be no problem.

I was very disappointed by my lawyer. I told her I never expected to go to trial. There was no point. Everything could be settled, compromised, negotiated.

I still remember our first (and only) meeting with my STBX at the time and her lawyer.

I swear, everything my lawyer knew about negotiating she learned on TV and in the movies. She wrote a number down on a piece of paper, and slid it across the table to the other lawyer, just like in the movies. The other lawyer looked at it and said, "See you in court", and they got up and walked out.

THAT'S IT? I was shocked. That's ALL she could do?

I guess my point is don't expect your lawyer to be a good (or even competent) negotiator. Plus, it doesn't help when the opposing lawyer convinces your STBX that she'll get 100% at trial, so there's no point in settling for less.
