I'd like to see how they'd have ruled if it was a woman calling him that, this is male on male so the Employment Tribunal critters are basically playing around with something they don't care one whit about.

I don't think it should be considered sexual harassment, because the scalp isn't (usually) explicitly involved in sexual activity. Breasts, as a secondary sexual characteristic, are a component in both sexual attraction and function (since they typically consist of erogenous zones). Thus, any remark about breasts is almost inherently sexual in nature, even those with platonic intent, since it is a remark on a key aspect of a woman's sexual desirability. If someone was to remark on someone's penis size or shape, for example, then that could absolutely be considered sexual harassment for similar reasons.

However, bullying someone over baldness should constitute some form of workplace harassment. Baldness can be a source of insecurity, and men's mental health around body image/dysmorphia is often overlooked in general. I suspect that calling a woman 'fat' could end up with a similar charge, perhaps even a 'hate crime' charge given that body dysmorphia is typically (incorrectly) attributed as primarily a women's issue.

The tone of the article is very dismissive and disdainful, but that's hardly surprising from the rag that is The Guardian.

I really don't agree that remarking on his baldness would be like remarking on the size of a woman's breasts. At all.

We need workplaces to recognize general harassment, which is far more common, instead of only taking specialized harassment that's based on a person's identity seriously.

If a woman is bullied at work, she can claim harassment on the basis of his gender.

If a man is bullied at work, he just has to take it. Or if he reacts to it at all, he'll probably get motte-and-bailey'ed while the bully pretends there was no bullying and say he's being "too sensitive" or even 'fragile'.
