Yes. She just doesn't apply for it and you don't include it in the settlement. It's a civil case after all.

Discuss it with your lawyers, but when she does get a lawyer, they'll probably try to convince her to go after child support and alimony, and anything else they can get their grubby little hands on.

Plus, she can change her mind at any time and take you back to court for it.

Lastly, it wont matter what you gave to her before the final divorce order.

Only if she does not pursue you for child support. It's entirely possible that you and her reach a formal agreement. But if she wants child support, and asks a judge for it. She will get it.

not usually, as the state's position on this is that if you don't pay support, they will need to support through low income housing vouchers, food stamps, other aid.

If she were to ever claim/apply for any of those the state looks for a pocket/father to seek reimbursement. It is this situation the judges say they are trying to avoid by setting up adequate support from the start.

In reality, the states are incentivized by the federal government by not only the establishment of min. child support #s but of the enforcement of collection of these same amounts. This is why the penalties for lack of payment are so strict by the state. So, everyone involved has a vested interest in establishing a set amount and making damn sure you pay it every pay period.

If you soon to be ex is truly as wonderful as your post suggest, the best option would be for her to simply gift these funds back to you each pay period. Let me know how long that lasts.

Well I want to keep it that way that is ...shes very easily convinced....which can def go the other way down the road....and id prob be on the streets within a year

There may be a requirement for her to sign a waiver stating she doesn't want child support. I know that exists in NY state. If there is, make sure she signs it so it doesn't come back to haunt you later, ie you owe several years of CS because there was no formal declination on her part. Again check with a lawyer. Even if you're going no contest you should at least consult with someone.
