I'm Interviewing Title IX Coordinators about Due Process. Any Advice?

Go Socratic. Don't ask pointed questions. Just let them talk.

Wherever possible, rephrase the question to make yourself sound less hostile. For example, "What are you doing to ensure the rights of the accused?" sounds aggressive, and they'll go into PR mode. Asking "What are you doing to protect yourself from potential liability if a student claims to have been falsely accused (cite Nungesser)?" will potentially get you much more useful answers.

Most Title IX offices use the motte and bailey informal logical fallacy, which is a sort of reverse straw man. It refers to a medieval town style where the 'motte' is the farmland and the 'bailey' is a defensible keep in the middle. The fallacy is when somebody holds a hard to defend position (the motte), but switches to a more defensible position when challenged (the bailey). This strategy relies on the audience not knowing the existence of the motte. If you sound friendly, they will gladly give you a tour of the motte (if you're lucky, you might even get a good money quote about how it's worth expelling a bunch of innocent men if it makes the women feel safer), and only realize too late that they should have stayed in the bailey.

I dont have advice because I hate everyone that works in the Title IX office, they're worse than HR.

I dont know the particulars of your project but I would LOVE to hear a Title IX coordinator give an explicit answer to how a young man can leave a sexual encounter and know for a fact that they did not commit rape. Theres really no way I just would love for it to be on record.

I dont know the particulars of your university and its rules but at mine if you are alleged of sexual assault or rape then your schedule changes (youre moved around in classes, moved out of your dorm if shared, or in some cases just thrown off campus entirely) all because universities are bound to create safe and non-hostile environment (for girls)....yet isnt the university just as legally bound to provide both students that environment? isnt jacking with someone's schedule etc not creating a hostile space for them?

I would also LOVE for a Title IX office to go on record that somebody pulling the stunt mattress girl pulled would qualify as creating a hostile environment for a man.

I would ask if they felt these policies which dont outright denote pure unbridled favoritism but certainly lend credence to it were one of the pressures pushing men out of higher education? (they wont answer this one because it would be a tacit admission that they were allowing a very hostile environment to be created at the institutional level which would be wholly their fault).

Shit maybe just go for the gold and ask if they feel if its even possible for a hostile environment for men to exist and what the hell they think it would look like and how that differs from where we're at?

If you know your university had any kind of orientation program where they used the study 1 in 5 women will be raped before their first class, then you might show them the video where the authors of the study came out and said their study cant be used like that and that it doesnt say that...then ask if they felt the promulgation of a demonstrably false narrative with the university's prima facia approval could be construed as a hostile environment?

If your university has a women's only gym hours or a women's center or women only scholarships but not a men's equivalent if they felt this favoring of the majority could make the student male minority feel less wanted or possibly even that the university was hostile to them?

You could follow up and ask since sports are strongly regulated by title ix in both numbers and funding if they felt having these programs for only women and not men was not anti-thetical to the very spirit of title ix and while not yet challenged if they felt would legally prevail since neither a men's alternative exist or doesnt at the same funding level? and if they feel this disparity is in-line with title ix's missive why is that so? Why are males now the minority but title ix seems to offer them little relief? how can that be?

I would suggest you ask for opinions on the fairness of the process. For example, "do you think it's possible that an innocent person might be found guilty under this process?" "Do you think that the preponderance of evidence standard is too low to expel someone from college?"

I think the advice you came with is better than what you have been given here,

your looking at a Star Chamber your job is to inform as meany people as possible that if they are hit by a title nine complaint, then they have been found guilty and will be summon for sentencing in a court were no evidence, fact, or part or reality matters.

It is therefor not worth dividing the holy from unholy, to do so is to (lightly) misinform the holy that they will always be safe.

Ask them to explain themselves. Don't challenge much. Then do your research to disprove their talking points. It shouldn't be hard.

Compare and contrast their opinions with opposing comments made by supreme court judges, or respected lawyers. It shouldn't be hard to show that their process is entirely counter to all legal tradition.

You could ask about their opinion on the idea that the misuse of title xi has created an environment where the fundamental legal right of the presumption of innocence is being stripped away from men. It's being stripped away because of the manner of which these trials are conducted. Like you already said, there is no cross examination, and they use preponderance of the evidence. There is also a climate in universities that preaches the "believe the woman no matter what" to the point of religious fundamentalism. That, paired with college administrators who do not have formal legal training and are most likely trained under the women's only title ix, makes it clear that men do not have the presumption of innocence. Title ix administrators forcing men to move classes and possibly leave campus sure seems like they are creating an image of guilt around a person who has not even been convicted. They are punishing you for a crime you have not been convicted of, and if you're falsely accused, they are punishing you for a crime that you didn't commit at all.

"How do all of those factors contribute to the guaranteed right to the presumption of innocence?" That would be my big question. And as it sits right now, the answer would be "it doesn't".

Ask them if the lack of due process creates a hostile educational environment for male students (only) which in turn constitutes a violation of Title IX's prohibition of sex discrimination in the provision of education.

Ask how many female defendants they have had (if any) and whether the literature and training they put students through mentions the possibility of male victims and female assailants.

If young men (but not young women) are worried about the possibility of being falsely charge with rape by the college, and this effects the young men's education negatively, is the college in violation of Title IX by refusing to remedy the hostile environment, even if the college rules are in theory equal, but have a disparate impact on men?

How would the co-ordinator handle a complaint by a male student who made the claim that their education was suffering because of a hostile environment created by the college's interpretation of Title IX as applied to date rape accusations?

Ask them what training and/or qualifications are required to successfully and objectively investigate something as sensitive as sexual assault.
