Presumption of paternity doctrine is such a travesty. The government should really only be issuing birth certificates based on science (DNA) and not common law.

Wow, excellent point! Forcing men to pay child support for kids who aren’t theirs is basically modern-day economic servitude. Didn’t know the 14th Amendment had this hidden clause about financial enslavement.

I'm against child support in general, the only exception being if the mother is unable to get a job or can't provide for the kids and the father is rich.

My Uncle has to work numerous dead end jobs to pay for Child Support to a woman who works 2 days a week and gets paid a shittone of money.

Of you were able to fight a child support case in a normal court then this might have some legs. But constitutional rights don't apply to family law nor contract law. Those are separate court systems.

This has been argued in court.

A claim that a child support or spousal support obligation violates the Thirteenth Amendment will not be successful except if a court enters a seek work order for a specific job or a specific employer, or if one party to the divorce is ordered to employ the other party. Despite concerns to the contrary, this will not change.

In other words, slavery is not "when you have to pay for stuff." Libertarians try the same argument with "taxation is theft" and it doesn't hold up there either for obvious reasons.

The government can even force you to seek work to pay debts you owe, but not a specific job. If the government forced you to work a specific job, that would be slavery. If you are free to choose where you work, you are not enslaved.

The only thing I can guess is that there haven’t been enough cases that have been raised to SCOTUS yet, or ever for that matter, for them to make a ruling. Until then, we are stuck with whatever congress will or won’t do about it. 🤷‍♂️

Another interesting take on child support is that the non custodial parent pays prorated to the degree of custody they have what the state pays for Forster care and half of reasonable expenses like medical insurance

The argument you will get is that child support doesn't require the child to be biologically yours. The governments have made rules about who has to pay to support children.

And there are ways you can get out of it. But if you don't confirm, that's sort of on you.

Hey, I'm all for equality and fair treatment for all, but let's not forget that the 14th Amendment also protects the rights of children to be supported by their parents. Whether or not the child is biologically related to the father, they are still deserving of financial support and care. Plus, let's not forget the old saying "it takes a village" - so even if the man is not the biological father, he can still help raise and support the child. So instead of seeing it as a violation of the 14th Amendment, let's see it as a way to ensure the well-being of all children.
