While murder carries a maximum term of life imprisonment, infanticide has a five-year maximum.

But it is believed no Victorian woman has ever been jailed for admitting a single count of infanticide.

Sentences have ranged from good behaviour bonds to lengthy community corrections orders

Men have been given longer sentences for being unable to pay more in child support than they earn.

Because you know, that's incredibly harmful to a child.

The tone is subtle, but it almost seems like they are celebrating the fact that we have this 'get out of jail free card' that we can pull out of our back pocket when women kill their infants.

This is just one more plank in the edifice where there's a second justice system for women than there is for men. You abandon a child as a father, you're a deadbeat and a cad. You abandon your baby as a mother, there's drop off locations or surrender options or adoption and no one will think the worse of you. You beat your child to death with your fists as a man, and you're in jail for murder. You beat your child to death with your fists as a woman, and you're released on a community bond for infanticide.

Any chance to rationalize and excuse the behaviour for the specific circumstances for women are taken. Any chance to rationalize and excuse the behaviour for the specific circumstances for the man are ignored.

We have a society where half of us have responsibility, and the other half have excuses.

All people should be forgiven for temporary aberrant behavior away from their baseline. We focus far too heavily on punishment, and not enough on preventing things from happening by giving attention to the circumstances and needs of citizens.

Women are not crazy. People are crazy. In general. I'm not saying to judge women less harshly than men. I'm saying to judge everyone less harshly across the board.

One of the things that really bothers me about this subreddit is that it never focuses on, "society should lighten up on men, and treat us more how it treats women." It's always, "it's bullshit that society doesn't treat women as shitty as it treats men, everyone should be treated as shittily as we are."


It's fucked up. But I think we should take a moment to consider the hormonal state a post-birth woman can be in. If a woman already has emotion regulation issues because of her hormones, birth can send them over the edge. It's not their fault, really. You're responsible for acting on your feelings, but you're not responsible for having them, you know? But when any feelings are really extreme, you can come detached from reality and do horrible things. And that, really, isn't an individual's fault.

An infant death is something I never want to see. But punishing someone that acts out of post-partum depression extremely harshly accomplishes nothing.

The key with this, as with so many other things, is huge doses of prevention. Checks with new mothers. Mental health evaluations. Home visits, maybe.

I'm a lifelong sufferer of mental health issues, so I guess I empathize with being betrayed by my brain.

I sat on a jury pool for a guy that committed insurance fraud in order to buy pain pills. His lawyer argued (basically) that he had become an opiod addict because none of his doctors gave a shit and so it wasnt really his fault because he trusted them and once he became addicted he was powerless because his addiction was too strong a force on his judgement.

What about people that drive drunk (or have sex while drunk, I guess thats technically rape now). These are things they would never do sober but they still did them. Are they less responsible?

If you want to give women a pass because they of hormones and cant be expected to be reasonable enough not to kill babies (a fairly low threshold I would think) then you have to accept that people are going to assume women are hormonal and prone to crazy. Do women really want that? Well here it is enshrined in law. Women's hormones and only women's hormones make women crazy. The law outright says it expects women to be crazy.

As long as you judge women less harshly than men you keep the door open for people to respect them less.

Sorta...poorly phrased, but I get what you're going for. These are very unpopular opinions but I think A) the legal BAC is too low, B) if you can't drive a car while minorly intoxicated, we probably shouldn't trust you to drive at all because it indicates that any single push away from baseline functioning from any cause turns you into a risk, C) the punishment for DUI without any injury or property damage should be community service.

I cant be arsed to find the study right now but basically the people that most commonly commit violent crimes (especially sex crimes) were abused themselves at a young age. If we follow your example to a logical conclusion what IF (thats capitalized) it was the case that the vast majority of perpetrators were victims themselves at some point. How would you alleviate the fact that despite being victims they are still propagating violence and anguish amongst society?

I think, its possible for both of those things to be true. I dont want society to treat women as harshly as men. However I understand the reality that society will never see treating men like shit is bad unless women are also treated that way...then it will be a problem and it will be solved. A good example is alimony. Youll never convince society to treat men better unless you can market it as also helping women. Well for some problems women have to experience it first...like the draft. Thats just reality.

Why just temporary?

At least if you forgive the temporary cases, you're catching the majority of cases that were caused by circumstance, not innate traits a person has.

Temporary = Forgive

Not Temporary = Forgive and Mandatory therapy for whatever the problem is.

You're probably going to sense a trend here, but mandatory therapy at increasingly long intervals. For life.

Using those shitty terms will never, ever help advance any solution. Think rationally, and discuss politely.

I dont see how you can say women are more hormonal than men therefore they deserve more leniency...Either women are more hormonal or they arent. If they are then you cant expect people not to think they are more hormonal.

That requires some deconstruction. Because "Either women are more hormonal or they arent." is patently false. Hormone concentrations in the body can vary wildly based on age and circumstances, and behavior changes accordingly.

in general, don't deserve a pass just for being hormonal. But it's also undeniable that women are more hormonal during PMS, and are much more hormonal during and after a pregnancy. Pregnancy and the period following is not a normal state, and should not be treated or regarded as such. Bad behavior during PMS is expected to be regulated because a standard woman has had around 13 periods a year since they were 12-13. It's expected they've learned to handle it by then. Whereas society overall is still struggling with how to treat women immediately post-pregnancy, and it's something an average individual female only experiences a handful of times during their life.

What do you think about fathers that murder their babies?

It depends on the circumstances really.

Because they're stressed in general is a pretty poor excuse, much like PMS above, it's expected you've learned to handle stress over a lifetime.

Because they've found out the child isn't theirs? Pretty reasonable and an honestly instinctual reaction, really.


Here's what the key point comes down to. We need to do a better job as a society preparing interested parties in being parents. I don't understand, at all, how society continues to treat having a child as this frivolous regular life event that's on par with getting a puppy.

There seriously should be mandatory classes, maybe in highschool, explaining the psychology that goes along with the whole experience. That it's normal to have thoughts of killing your child - that these are regular intrusive thoughts that occur in a significant percentage of the population. They should explain what post-partum depression is, and all the psychological effects that can go hand in hand with it.

There need to be resources made available for any parent, any person, who feels overloaded and overwhelmed with their life. It needs to be impressed on every citizen that it is okay that it is adminrable to reach out and ask for help when you need it. That everyone should. That you don't need a strong family support system, or a church, to ask for help - there are agencies and health professionals to ask.

But then this goes hand in hand with our totally fucked outlook on mental health, health care, government services and etc. These services should be available to all and free.

Not really. It can be taught through CBT. Or DBT. Both work, and have been working, for at least a decade now.

Better to try something different than to keep doing what we absolutely know doesn't work. Putting people in jail just makes hardened criminals. We absolutely have to shift the focus to rehabilitation and prevention instead of vengeance and punishment.

It's not that simple.

If I shot you full of testosterone, and you beat someone to death in a rage, is that your fault, or the testosterone?

Because I'd blame the T. But I also wouldn't say that you're too emotional to do certain tasks. I would say that you were subject to a transitory mental state that caused you to commit an act a single time.

Same thing with pregnancy, except it's the body dumping the hormones, not an external agent injecting it.

It isn't as if postpartum depression is random, it spefically happens around or after birth. Considering the pain, emotional stress, cost and changes in your body and hormones it isn't strange that it happens, especially considering how many people heavily judge new mothers. Killing an infant seems very drastic but you have to consider that the child is the source of all of the pain that the lady is going through together with the intense responsibility that the child will have her bear, the laws don't seem that strange anymore.

I kinda agree with you. You are trying to determine the cause of the crime, which is good. But unless you think some people are born evil, you will be able to find a cause for every crime. Abusive parents, lack of parents, childhood abuse by others, mental disorders, substans abuse brought on by on of the above.

By and large most people would be able to have their sentence reduced. Sure we could do more to prevent in from happening. Just like after school programs in poor areas. But once it happened. It happened. It's sad that a mother would kill her child, just like it is sad a 16 year old shoots and kills a store clerk.

Yes it is their fault and if you want to plea insanity, there are already avenues for that. You're supporting a class of crime that can only be applied to one group. There's no way of treating men leniently when your argument rests on pregnancy hormones. There's no other practical solution other than the abolition of infanticide as a distinct offense.
