No she doesn't pay child support. She gave the child up for adoption. Giving a child up for adoption relinquishes the parent of responsibility for the child.

Because the second example doesn't involve adoption. The examples you provided are not analogous. Abandoning parental rights is not equal to adoption. I understand the point you're making, but the two situations are not the same and should be treated differently.

I think at the point of adoption the mother is released from all legal requirements attached to the child. We would have to contact a family law attorney to know the specifics.

The "adoption" makes it a different kettle of fish, legally. An "apples to apples" comparison would be: Woman has baby, decides she'd rather run off and join the circus instead of raising the child. She gives child to loving, stable father. Does she pay child support?

Your 2nd example could remain the same.

I personally don't even see how it's reasonable for a child to be put up for adoption when at least one of the parents wants custody.

On the topic of child support though, I believe financial abortion should be an option to men; being able to opt out of rights and responsibilities to a child early enough so the mother can choose to have an abortion knowing that she would have to raise it on her own. If the decision is held off to long so that an abortion isn't possible then I think he should be responsible for the child support. Just the same, I think if the mother doesn't want the child and the father does, he should get custody and she should be responsible for child support. And, as always, if the woman wants an abortion that is her right, no matter how much the father wants to keep it, it is a part of her body and it is her right to have control over her body.

As far as I know, biological fathers do not "adopt" their own kids. They are granted legal custody, and then the bio mother would be required to pay support.

I have a similar situation occuring with a distant relative. They were going to adopt a newborn baby from a woman who had a one night stand. However, at birth the bio father came forward and requested a DNA test (came back positive) and then he decided not to sign off on the adoption and instead will be recieving full custody with child support paid to him.

The answer is no, in that case, mothers do not pay child support.

The law may say she should, but in reality, no woman has ever paid child support for a child she gave up right after birth (even if the father got custody later).

Are we talking should they, morally, or can they? Legally, the mom wouldn't have to in the first, and the dad would in the 2nd, since we don't have that option.
