I have read a number of articles in which it is suggested, or stated, that the Human Tissue Act 2006 makes it impossible for UK men to disprove paternity by DNA testing without the mother's consent.
On reading details of the act, this would seem not to be the case. It is merely required that a guardian (for a child) give consent for the child's DNA to be tested against that of the presumed father. The purpose of this is to prevent unrelated people keeping and/or testing genetic material they have not connection with.
Guardians include the father and only one guardian is required. Now, in most marriages, asking consent from the mother is asking for trouble and strife and the requirement to do so is a major obstacle for men with a bit of doubt. This law does not prevent a discreet test taking place, regardless of what the various articles appear to be saying.
The myth that a man cannot confirm paternity of his presumed child without informing or getting permission from the mother is unhelpful and serves only to propagate conspiracy against cuckolded men, since a man who believes it will tend not to find out what he needs to know.
MRAs must not make things harder for men by spreading these misconceptions.
There would however be a problem for a man with reasonable grounds for believing he is the father of a child and wanting to be recognised as such since the act makes it very difficult for him to prove the case. Such a test would need to be carried out by court order, if the mother is unwilling to give consent. However, this is an entirely different issue from the one the articles are dealing with; that of laws conspiring to stop men finding out they are raising another man's child.
