After 6 months of being divorced my ex is now threatening child support. She wants to claim our daughter on her taxes this year even though it is not her year because she claims our daughter has stayed with her more which is true by about 1 month total for the year for various reasons. Our regular schedule is ½ and ½ but I travel some for work so she has to stay with her mom more. On our divorce agreement doesn’t outline who gets to deduct the child year after year, my bad. BUT is does say that my ex will not pursue child or spousal support after the divorce is final. I provide health and dental insurance through work for my daughter and I pay her cell phone bill. Everything else is spilt 50/50. What’s going to happen if this is taken to the courts? Will our notarized agreement we filed in the divorce that she won’t pursue child support stick in court or will they still look into all our expenditures and bills and make a determination?
