This lady.... gross.

She got all caught up in the ivory tower academic bullshit pseudo science, raped a disabled guy and thought it was totally justified. She had supporters rally around her. This is where dogmatism leads. I hope she goes to prison for many years.

And "facilitated communication" means crap when the person is weakened enough that they can't move their own body by themselves. Especially when the man is mentally disabled. She probably grabbed his hand with her own hand, and typed everything out. That was her speaking not him. She needs to be locked up for a long time, otherwise she'll do this to another innocent victim. I bet this is how she "cares" for her daughter with bipolar also. Rape and sexual assault is never isolated or limited to a single case.

'There is no methodologically sound study in the US or the world that confirms this practice works,' he said.

Judge Teare had barred expert testimony on facilitated communication during the trial because she determined that it was not a recognized science.

It seems the judge wasn't too impressed with it.

It might, but it may not have been tested in court.

The logical thing would be that if you are unable to consent to sex because you're mentally ill/disabled, then you're probably not able to have responsibility for any crimes you commit, either.

But we know that the law doesn't always make logical sense, so who knows?

Well, so... in the more extreme cases of mental incompetence, they are a ward of the state, or of caregivers, or custodians, etc. The person or people in charge of their wellbeing are responsible for their doings. For example, if a person with an extreme case of retardation goes and spraypaints their name on a wall, the person who was in charge of them takes the fine, because it was their responsibility to keep a handle on the retarded person's activities. As you can see by the tagging in LA, there's a lot of retarded people, and few responsible caregivers.

So, if hypothetically, caregivers left 2 mentally incompetent people (who commonly have fully functioning sex drive, and rarely any inhibitions about sex) alone long enough to reproduce, the caregivers would be legally responsible.

This is as disturbing as the rape. A Rutgers University professor was delivering lectures, and subsequently "training" on facilitated communication...a thoroughly discredited pseudoscience. This fact alone makes Rutgers at least partially liable in my opinion...let your professors teach that nonsense as fact, you have liability when people believe that nonsense is fact.

What the actual fuck lady...

My mom took care of a very nice lady with cerebral palsy when I was much younger. Absolutely I believe this guy had no way to consent. Details may vary case to case, but if he is anything like she was, he would have agreed for coloring time and a batch of ramen noodles.

Edit:

Difficulty with the ability to think or reasonand seizures each occurs in about one third of people with CP.

It is less common than I thought I suppose, but still...

I wish they'd stop using "cerebral palsy" and "diaper-wearing" as the primary descriptors for this man. Neither of those things made him unable to consent to sex. It is his extreme intellectual impairment and total lack of ability to communicate that are at issue here.

It's unfortunate but most people are not very familiar with anatomy and physiology. So it comes down to 'he must be retarded' if he needs a diaper past three, since they don't know it could be an issue with his sphincter simply not working, or his ability to send neural signals to his muscles to close that sphincter. Or the neurons send the signal, but the electricity doesn't jump the gap from neuron to muscle. So on.
