Another BS reason my ex gave me was…she wants them to have something “routine to be consistent” and wants them to “grow up in the house they’ve been in”. Both bullshit as we can make 50/50 “consistent” and they are going to have 2 homes. Not 1. All BS from the real reason. I haven’t complained much because the 4 months in I keep taking the kids on days she should have them because of her hectic work requirements and will actually have them 50% time, if not more…it’s just not what the court order…

Ego, Reputation, Control, Child Support, sometimes it being frowned upon from societies norms. I have about 46/54 and she just couldn’t go 50/50 and the state i’m in doesn’t allow 50/50 unless we both agreed to it. I still don’t know the reason why, and I’ve asked multiple times but I’m sure it’s a combination of a few things I mentioned above.

No home, I don’t have a 401K, nothing, She has a 100k in 401k, 50k bonus, 75k in restricted stock. We both have 30k debt post marriage. She also has 100k student loans and makes 4x the amount i do. She makes so much because I supported the kids, moved three times for her career, and turned down multiple job opportunities making 40k more so I could have a job where I would be able to take care of the kids because she could not due to her time demanding career. I don’t think so in Texas. In Texas if the other parent has then just 1 day more the non custodial parent would be due child support if we brought it up to a judge. Texas uses a calculator and the non custodial parent based on 2 kids would need to pay 20% of thier net income. Now given that there is a LARGE income dilatory I would wouldn’t have to pay that much but here would prob still have to pay something if she pushed for it.

I think there is some confusion here. I’m fine staying with the 55/45 custody for the final orders as I will end up seeing them 50% of the time anyway. Although I technically don’t agree I don’t have any more money to fight this in a trial. My concern is if I ask for 50% of her financials that she will then say “well you need to pay me child support now”. That’s why do you think my best coarse woukd be to ask for 30-40% of the financials to get this finalized in mediation so we don’t have to go …

Unfortunately it’s not. It’s not even in thier family court code. One parent is the primary custodial and the other is just custodial. Visitation is for the custodial parent to get the standard possession order which is every other weekend and Thursday for a couple hours or expanded standard possession order which is a few more days. The only time it’s 50/50 is when both parents agree:

As of today she still hasn’t told me. She stated that she has been reaching out to a couple attorneys and the holidays have caused delays lol. Should I believe anything that comes out of her mouth?

They have no dirt. She is going to file a temp order for primary custodial and try to get me out of the house. Her mother in law is now living with us so that doesn’t help. My concern is she gets primary custodial and it carries over to final custody. Since she filed first and filed the temp order do I say I also want primary custodial at the temp hearing and feel it’s best for the kids to stay in the house???I can’t see my kids less than 50% that is not an option. Also, as of this morning she states she has been talking by to lawyers but everything has been delayed until after the holidays. Complete liar. Didn’t tell me anything about filing or the orders. I’ll be going to the courthouse first thing Monday morning to get a copy of the filing and orders since I still haven’t been served. She is trying to delay telling me for some reason.

If TRO was one of them, why isn’t t hearing until 12/18. Wouldn’t that claim be handled immediately. Think the temp order are all about custody and her having exclusive access the house

Good point. Feel as though she may be unsure or is avoiding any conflict. Was filed on the 14th, citation states the 19th…maybe it just hasn’t came to me yet and she would prefer me finding out getting served to avoid conflict. Idk. Is there a strategy she could be using by delaying me being served?

Wife filed, hasn’t told me about it. Found out. She wants to go to a mediator but doesn’t want me have 50/50 visitation. No point in going to a mediator when anything less than 50/50 is non negotiable.
