Now that we have a precedent to point to, health insurance, they can't hide behind the statistics they've always used to keep men's rates higher.

Women inherently cost more to cover as well. Men are not inherently bad drivers.

So charging women more for healthcare makes more sense than charging men more for car insurance.

Also, the same goes for car insurance as life insurance, and ironically enough part of the reason men die earlier is because of poorer healthcare.

‘‘(a) IN GENERAL.—An auto insurance issuer offering group or individual auto insurance coverage may not establish rules for eligibility (including continued eligibility) of any individual to enroll under the terms of the plan or coverage based on any of the following auto status-related factors in relation to the individual or a dependent of the individual:

‘‘(1) Health status.

‘‘(2) Medical condition (including both physical and mental illnesses).

‘‘(3) Claims experience.

‘‘(4) Receipt of Auto care.

‘‘(5) Accident history.

‘‘(6) Genetic information.

‘‘(7) Evidence of insurability (including conditions arising out of acts of domestic violence).

‘‘(8) Disability.

‘‘(9) Any other auto status-related factor determined appropriate by the relevant Authority.

The expected rate of use of required insurance (health and auto) based on a protected characteristic (sex) should not impact the cost at all.

I think most of the logic is fairly sound. The only argument against it would be that the difference in woman's health issues stems mostly from having different bodies that require more expensive treatment. Having to face these issues is not a choice made by women, with the exception of pregnancy which we don't exactly want to discourage. I would assume men get billed more for auto-insurance because men get in more accidents. To some extent that is because of the choice to take more risks.

Should an individual be penalized because their gender has a tendency to make certain choices0, probably not. Is it good business practice for insurance companies to do so, apparently. Is the government willing to step in when an individual is penalized based not on the choices their group makes but for the bodies they are born with, looks like it.

If statistics show that young men are more of a financial risk, then as a private company they can decide to charge whatever they want. If their statistics are wrong, then the company that gives lower rates to males will benefit economically.

Let's not turn into sniveling male-feminists that want the government to pander to every difference between us.
