Child support is meant to pay for half of what it takes to raise a child, she must cover the other half. It's not your problem unless she gets some sort of court order to increase the amount you pay.

You're not obligated to do so, but she may very well take you back to have it readjusted. My brother pays child support and child care is part of that. He will spend money on his daughter when he has her, but does not give additional money to the mother. Most daycares should have sliding-scale or subsidized services. You should check into those in your area

No you already have a court ordered settlement. Or what you can offer is you'll pay for half of daycare but then get the court to readjust the settlement based on her income. It works both ways. If she hits the lottery you can take her to court and say she doesn't need the money. However having said that who will take care of your child while she works. Me I love my kids as long as I got a say and where they are put I would most likely help pay.

I'm in NJ....we have 50/50 custody, but I pay for daycare in full, on my own, in cash to the daycare. However, somehow, because of the income disparity (my 60 to her 15) she may still get Child Support when our divorce is finalized. WTF Over.

Not sure about Texas, but in some states they make you pay for half of childcare, too. It is supposed to be half of childcare necessary for work when both parents are working, but the courts don't follow the rules.

I am on the hook for half of childcare so my abusive ex-wife can stay at home while the kids are in school and daycare and spend her time legally attacking my family and me with more lies. She also dumps the kids into daycare and camps when my family and I could provide care for them for free.

First of all, I am not a lawyer and this is not legal advice. However, I am a divorced father who has dealt with the so-called "family court" system.

No, you are not obligated to pay anything more than what your court order specifies and a judge would have to approve a modification to your order to require you to pay more.

She may take you back to court and attempt to adjust the child support based on increased child care expenses but if she is working and has an increase in income this may actually offset any increases in expenses, assuming that Texas factors in the income for both parents when calculating child support.

You should never, ever, under any circumstances, pay a cent more in any fashion than the court order UNLESS you and your extended are unable or unwilling to offer to take more care of your child/grandchild.

If you can't contribute to the cost of care by doing some care yourself (example, working a night shift so your child only needs to go to say are from noon until whatever time her mom gets off work), and your folks can't provide any care, then you should probably look at how much the care is costing, and ask yourself if your support amount plus an equal amount from mom's resources will cover the daycare cost plus your child's needs. If the answer is no, you STILL don't pay more money. What you do us take on a larger share of some other expenses - like clothing - to get back to 50/50 balance in terms of how much each parent spends to meet the child's needs.

the reason she is asking you is that the state is taking a chunk of your child support payments to repay her welfare benefits, and if she can get the additional money directly, the state won't get a cut.

Nope, by all means let your ex find the cheapest place possible. It's her problem that she has a kid to take care of, not yours. If her kid has to go to an abusive daycare, then obviously, that's her problem. You don't have to pay a goddamn cent more than the state says. Maybe you could help her find a place that doesn't necessarily adhere to "state standards" of daycare. I bet she could find someone to watch her kid really quick and really cheap that way!
