a woman could keep proceeds from a divorce agreement, even if those proceeds were the ill-gotten gains of a financial fraud perpetrated by her former husband.

How is this ok? This is stolen property. I don't understand how a judge could make this ruling.

Poor little rich woman, her need is greater than those robbed by the ponzi scheme, apparently. He was a monster, she was a saint who never in her wildest dreams could have known what he was up to.

This is terrible...

When they got divorced, they split their marital assets. But if those marital assets weren't in fact theirs, how can she still keep half? It is keeping half of someone else's property.

Hey honey, I have an idea. I'm going to steal a shitload of money using paper and pen. Then, we'll get a legal divorce and you get the money. I may do a couple of years in prison at most IF caught. Otherwise, we can continue living together and they can't do shit to get the money.

Again, this is just like the whole thing with a woman gaining sperm via illegal means but the male still being responsible for the resulting baby. The ethics of law have to take a backseat to what is best for a woman in this country.

In ruling for Ms. Schaberg, the court made an analogy between Ms. Schaberg and her divorce settlement proceeds and any person who unknowingly receives tainted money in a business transaction. For instance, the government could not seize stolen money from an architect whom a thief had paid to build his home.

In a way this seems to make sense. But this example given is payment for services rendered, which is not the same as splitting up assets in a divorce.
