Clearly, the main problem here is ideological — gender bias. Try to imagine a scenario where a father hits a mother with his car and the mother is arrested and then cut off from her kids, while the father isn’t charged with anything. You can’t–it’s impossible.

From the YouTube video of the incident:

Mom and dad have joint physical care and alternate equal parenting time.

Storyline (video from school surveillance camera) :

If you fast forward you will see mom walk into the school to get her daughter (her non-parenting week). The mom walks the child out to her van.

Dad just arriving to pickup the child (his parenting week) runs in front of the van to stop the mom from leaving.

Mom, actually run into him with her van knocking the father down (assault).

When the police arrive, they arrest father for disorderly conduct at the ordering of the Chief of Police who arrives at the end.

Not Over Yet:

Oelwein Police Department refuse to draft charges against the mother for assault. County Attorney refuses to prosecute mother for assault.

Mom files for a no-contact order. Judges grants no-contact order and removes fathers parenting time, despite; 1) watching video and 2) mom testifying at the temp hearing that no physical or emotional abuse has ever occurred between the parties.

There are pending future court proceedings on the matter.

Reminder: Persons who receive federal VAWA funds and who discriminate against victims on the basis of gender in whole or in part using federal taxpayer dollars are violating federal law under 42 U.S.C. § 3789d(c)(1).

If two or more persons coordinate activities to discriminate against any person on the basis of their protected class (including gender) to prevent them from having access to any program benefit, privilege to which they are entitled by federal statute or the US Constitution (including VAWA services for victims), they are committing a federal felony under 18 USC § 241.

Please note that most police departments and prosecutor's offices receive VAWA funds with which they handle domestic violence cases.

Where is the video?

In most states, if one is confronted with a threat and chooses to use deadly force even though a means of escape is available, one would be charged with a felony.

This was covered in the CCW class I took Sunday. This is true in Iowa. You have to try to flee otherwise you are guilty of assault in my state.

Really and truly the saddest part of the story is it all took place INFRONT of their daughter, a divorce is hard enough for a child much less seeing this happen or anything of the like, i have similar experiences with my parents in my past and still resent my mother for taking me away from my father and keeping us apart, its wrong and people are so damn selfish they cannot see what they are doing to their kids.

Honestly, it looks like she didn't really do anything to him. He blocked her vehicle, she nudged him lightly, then started to push him MAYBE 5 feet where he slipped and held onto the vehicle at which point she instantly stopped.

Her taking the child was unreasonable. Her driving was hardly as unreasonable as the title suggests.
