I probably shouldn't have posted it on this thread, because it's going to be seen as an attack against other posters. It wasn't meant to be, I was trying to make a joke about how cases like this are often used to defame all other women who claim rape. But you're right, when I read it now it comes off as kind of preemptively defensive.

Though, I disagree with your last point. Our legal system is not at all friendly towards women who come forward with rape charges. Many rape kits aren't even processed, and there are many documented cases where police were hostile, and judgment is based on something about the girl ("well, you slept around, so why should we believe you?). In fact, just recently, a guy who basically admitted to the rape via phone (not a very smart guy) was not found guilty. I agree that there are cases where someone who claims rape is lying. Yet this is about as common as any other false criminal report. I've heard over and over again people claiming that most rape allegations are false.

I don't think the majority of the people here think women lie about rape all the time or even most of the time. The point is that women do lie about it and there are examples of innocent guys going to jail or losing custody of their kids because of an opportunist rape accusation or because a consenting sexual encounter was regretted the next day by an unscrupulous female.

All I advocate is: (1) protection of the accused person's identity, (2) a default assumption of innocence and (3) an objective trial, in which case if the alleged is found guilty, they are punished and shamed.

Your last sentence we'll agree to disagree on. You seem like a reasonable person, so there's no point entering a sledging match.

The point is that women do lie about it and there are examples of innocent guys going to jail or losing custody of their kids because of an opportunist rape accusation or because a consenting sexual encounter was regretted the next day by an unscrupulous female.

It's true that false rape claims do happen, yet I find that it's often exaggerated how often. So many people assume that when a woman makes a rape allegation, she's just trying to cover up a night she regretted, or is doing it for money (especially when the accused is famous - so many Polanski apologists I can't even count them). Also, I've never understood the idea that so many women would claim rape if they regretted having sex. If they regretted it, wouldn't they NOT want to bring attention to it, instead of publicly broadcasting the fact they had sex by claiming rape?

As per your other points, I do see the value in protecting the person's identity. However, there would have to be some way of protecting the public from the person should they turn out to be guilty (perhaps some form of probation). A default assumption of innocence is fine, as long as there isn't a default assumption that the accuser is lying. And obviously, an objective trial is absolutely crucial.

I'm debating with you not because I'm angry or dislike you, but because I think it's important to have these discussions, especially with people who have different perspectives.

I'm not sure I follow what you are saying here. Are you saying you are for granting anonymity to the accused, but want extra scrunity on the accused for some time after the trial in case they are acquitted, but in reality they were guilty, and they then go on to rape someone else?

Or are you saying that you are theoretically for anonymity, but don't think it should be put into practice because it would make it too hard to convict someone of rape and thus too many guilty would go free, which would endanger society?

In other words anonymity is a good idea in theory but not in practice.

Sorry, but I assumed because it was made here that it implied that /MR believes women either mostly lie about rape or look to somehow blame women for being raped. Such ridiculous charges have been levelled against us before

By whom? There are fanatics on both sides of the fence; you have the misogynists who think women are somehow at fault for being raped i.e. 'if only she didn't wear that skirt' and you have the extremist-feminists who think women never lie about rape, are infallible and should be taken at their word; and it's sexist not to.

Not I. Men, women, accused rapist, accused false-rape accusers etc. are innocent until proven guilty. No assumptions, just facts. That's the view we need to take. She may be doing it for money, the circumstances may make him look guilty; but until we get proof we need to give these people the benefit of the doubt.

It's not that simple - whilst your argument has its own internal logic, it ignores cases where women have been found guilty of lying about rape due to regret. I.e. there was a case in Australia involving a uni girl and (2-3 other guys), she had a boyfriend and decided to cheat on him with these guys gang-bang style - instead of admitting she cheated, she cried rape; to screw 3 guys over to save herself. So there are cases where women have had good reason to lie about rape due to regret.

I don't want to conceal the identity of the guilty, only the accused. For example, if I called you a murderer; the courts should protect you in case I'm wrong. That way your family, income producing abilities and reputation are not incorrectly destroyed. As the maxim goes; when you throw mud, some sticks. If it turns out you are, in fact, a murderer - then the society has a right to know. I don't believe guilty rapist deserve anonymity at all.

Agreed, you need to be neutral on all accusations then look for evidence to decide who is lying and who is telling the truth.

well the best way to counter that is to get your own house in order.

The feminists should be telling women to stop making false accusations when it suits them.

Why do you think there is such scepticism in society about rape claims? why do you think the police are so sceptical over rape claims? Is it because the police just hate women? or is it because they have experience of women wasting police time lying to them.

Im with Kanin. and I probably think most everyone else in society is too. I probably think alot of women think the same, but stay silent because they dont want to be guilty by association (of being a 'woman').

When you have experience of women, and the lies they constantly tell, and the trouble they cause, its totally believable that 40% of all rape allegations could be false.
