Are you from some weird country? Otherwise if you had a legal marriage in your home country then you are married and the US recognizes it as a valid marriage. You have to get divorced. Though I don't know which country you have to get divorced in or if you can pick.

If one of the below applies to you - you are married and state/USA laws apply to your marriage:

- You indicated your wife in visa application in embassy

--or otherwise - your wife stated your are her husband

- You filed taxes as married (either separate or joint)

- You filed any federal/State/local documents and indicated you wife - or otherwise. This would also include any applications to college that would be used in visa application above.

- In any case your spouse can do legal translation of marriage certificate either in consulate or any translation service - it would be valid in court.

If you can - move back to your country, file divorce and sty there most of time while process is finalized.

Speak to a lawyer. And as long as you're still married abroad and have lived in the US for 6 months, you're legally married here (i think).

If your marriage abroad was legally binding, then your marriage is recognized in the U.S.
