Why are the guys always like this?

I didn’t want to press charges not did I want her to get arrested so I don’t say she did hit me.

And as you can see, the women never has any hesitation to make a report.

Guys. They are NOT all Sugar and Spice and everything nice. They are cold blood alligators that will rip your heart out and then spit on it after its been stomped.

Men, you need to get your head in the game early. Stop cutting them a break.

Did you confess to punching her? Did you get arrested? If neither things happened it's unlikely that the tro will be successful. It's all hearsay anyway so if your mom was there then I guess you could use her as a witness. Also both you and your wife are biased but that's how family court works. If you have physical evidence that would be better. For example pictures of bruises when she hit you or texts threatening you.

Almost all witnesses have some bias. Courts will evaluate the weight of their testimony in light of such bias. An eye witness, for example, will likely be valuable to the court despite any bias, and because a witness will be subject to cross examination, their credibility may hold up. Ideally, there will be some cctv or another witness who can corroborate any testimony. But we play with the cards we're dealt.

If you don't have a lawyer for this, your witnesses can easily be turned against you, though. So you better consult your lawyer on this.

Huge mistake. You had your chance and you blew it. Your mom can help clear the TRO which needs to get done ASAP, but you aren't moving back into the house before the divorce is finalized.

You should get a hidden camera to record your wife hitting you. You might want to as you will need it to prove your innocence and evidence for your inevitable divorce.
