Should be in your divorce decree about who holds the passport and birth certificate. You can either swap each year or if you have multiple kids - you each hold a set.

Decree needs to specify upon request for the passport for international trip, etc - party A holding the passport has x days to turn it over and upon return from trip - party B has x days to return it.

Both of you have rights to it. This isn’t up for debate. You absolutely get a right to hold it 50% of the time. Make sure it’s in the divorce decree. If you need it now for a trip - ask your lawyer to communicated with hers. If it’s not urgent - just spell it out in your divorce decree.

Put it in your divorce decree. If your ex is a foreigner than absolutely get that Put in. I also got in my decree that I can get them new passports without her consent.
