What are my chances of getting split custody of my 9mo old? He will probably be over a year old by the time this gets to trial, and has been with his mom since 3 months. I see him 3 days a week but no overnights due to breastfeeding and mothers refusal to give milk. I have been providing formula without her knowing for the last couple months.

I'd like a step up plan but my lawyer says that judges don't often grant that and it's through mediation. I'm obviously very nervous due to my son's age and controlling mother. I know I can take care of him but our temp order that's been installed since October only allows me visitation. Any suggestions? I'm afraid I'll get no custody at all due to my ex's control. My lawyer said we need to keep spreading and delaying as to run the clock on my child's age and him becoming less dependent on milk.
