Gearing up to begin the custody discussions with soon to be ex, and one of the reasons that she is using is that I am unstable for having any custody beyond supervised visitation. I have a history of treated anxiety, but nothing much else - it's all anxiety related and I am medicated and speak with a therapist monthly. (Reduced recently because my therapist felt my progress did not warrant weekly visits).

Now I am getting wind that my ex saved some text messages from a couple years ago in which I mentioned something about killing myself. Now to be clear, I don't recall these messages and I am certainly not suicidal; which is properly recorded in my therapy notes.

Is this sufficient evidence for her to use against me and having custody of our son? My lawyer so far thinks it's irrelevant but we have yet to get all the messages.
