Over paid on Child Support

Don't count on it. I was paying CS for my son who was 50/50 with the Ex. In Feb of 2020, she kicked him out claiming she was scared of him and his anger issues. Things settled down after a month and he went to go see her again in March (supposedly for her week). She kicked him out again. He came to live with me full time for 8 months before I finally got a court date to get full custody. They terminated her CS but would not give me back the 8 months of payments that were automatically garnished from my paycheck, even though he was with me FT and I paid for EVERYTHING including the stuff she was supposed to pay half of. All I asked for was the 8 months of payments that she got that she really wasn't entitled too because he was with me. Court still didn't give it up to me.

I seriously doubt it. The courts don’t like to punish women…..only men.

Two issues here. 1) You have an attorney. Just by the way that he has responded to you stating that he wants to do everything at once is lazy. You wont get this money back.

2) If you’re done with divorce proceedings, just go Pro-Se. saved me thousands! File a motion to modify support. Thats what its called in Illinois courts. You can only do this if you no longer have an attorney. Since he is the attorney on file, you cant file it until he withdraws from your case.

I think your attorney does not want to file because of the additional work and i dont know how much he’s already over billing you. Good luck, but at this point its a loss.

Zero chance the only thing they will do it put it to the back of your childsupport so you could get off earlier
