That's where the website fucked up. The moment you screen comments before they appear to the public, you have taken responsibility for what is posted by third parties on your site. It's one reason I don't moderate comments and almost never delete any (doxxing, serious defamation when I notice it, incitement to violence, etc). You set comments to approval, that means every comment that gets published has been approved by you.

Personally, I don't know if the moral responsibility inherent in setting comments to approval should translate into a legal one, but at the same time, it's why I refuse to moderate comments on my blog or channel.

It kind of sucks that her life seems to have gotten better since she was with an underage boy. A man would have pretty much been crucified for doing the same thing. Now she gets over 1/3rd of a million dollars.

Regardless of her guilt in the molestation case, she still has a right to be free from defamation just like everyone else. The fact someone is convicted of a crime doesn't mean everyone is free to slander them.

I don't see how this has anything to do with Men's Rights. I understand her crime and I would be the first to say it's wrong but to say this litigation has anything to do with MRM is a stretch. It has everything to do with freedom of speech though which is relevant to everyone. I can say that if this were a man who was having accusations levied at him no one would blink an eye. The only way I can see this being relevant is in that she is being defended by the court for being a pedophile. It seems that women are acceptable as pedophiles and there are still some white knights more than willing to defend them.

Over all this is disturbing on many levels but mostly due to it's infringement on our first amendment rights.

First: The comments posted by Nik Richie and the Dirty.com were posted prior to any of the illicit conduct between her and the seventeen year old student. She pleaded guilty to sexual abuse first degree in exchange for felony diversion. There is no question that her civil suit would have been a great case, if she had not broken the law afterwards because it strains credibility. However she was still able to win by selecting the time frame in which she (her reputation) was injured.

Second: The court denied Nik and the Dirty.com immunity under the Communications Decency Act, because Nik reviewed all posts prior to publication, commented on every post, and decides what content stays up or gets removed. Full control. Nik's own testimony.

Third: The case is a federal case, and you can get access to all documents and trial information through pacer.gov. You do have to pay ten cents per page, but it is accessible. There were two trials with juries. The first jury was hung, the second jury came back with the verdict. In Federal appeals, for civil cases, the Plaintiff is not entitled to recover the judgment prior to the appeal without the permission of the court. Looking at Pacer there is nothing filed to ask the court to require the defendants to pay the judgment prior to the appeal. This is assuming that the Defendants have the money to pay the amount and don't just file bankruptcy.

I am from the Cincinnati area, where there has been a lot more coverage on this, and I happen to be an attorney that has been following the case. I sat in on the final two days of trial to hear the parties' testimony and the closing arguments. If it makes you feel any better, Nik Ritchie came off looking worse than Sarah.

The case is being appealed on whether Court properly denied immunity to the defendants. Those documents are also available on Pacer, under the sixth circuits sub.
