Guy was high on drugs and acting crazy/erratic in the street. He did cause the situation. I don't necessarily agree, but I can sort of follow their logic.

UK law here:

This seems similar to the UK legal principle that you are liable for any harm that comes as a reasonably foreseeable consequence to your actions. In Hayward v DPP a man punched a woman who, as a result, dropped her baby. He was held to have assaulted the baby.

The problems with situations like these come from the reasonably foreseeable part - what is foreseeable?

In this case, the basis of the charge is that, by acting how he was the man could reasonably expect to be shot at by police, and being in an area with bystanders he could have reasonably forseen that they could be in danger of crossfire.

Now, whether that sticks or not will depend on a whole number of factors that we, the general public, do not know, and in the end a jury will have to decide on the full facts whether that accusation has any merits. We, as uninformed outsiders, cannot judge on this little information.

I'd imagine cops in new york have their fair share of people firing weapons at them, so I can kind of understand why they fired on the guy who was trying to run away from them/dodging in between cars.

Here is the kicker: If you are stopped by the police for any reason the moment you reach down to your waistband/pocket you are pretty much giving them free reign to shoot you. Especially if you are not announcing that you are getting a wallet/ID but even at that time the officers, if needed, will retrieve it.

Then again in this country whenever you see the word "cop" and "shoot" and it doesn't involve a cop getting shot people will get outraged. Now if it is a cop getting shot you will have everyone around the country cheering for more.
