given that if they have had sex after drinking = rape then yes this statistic is probably true

but seeing how their partner would have likely also been drinking does that make almost 1 in 4 women rapists?

My criminal law text book has a very extensive note about rape statistics. (If anyone is interested, it's Kadish and Schulhofer's Criminal Law and Its Process, 7th Edition, pp315-17.)

Among college women, victimization rates appear to be even higher. A 1999 national survey for the Department of Justice found that 2.8 percent of college women had experienced a completed or attempted rape during the preceding six months, suggesting an annual victimization rate of roughly 5600 per 100,000 college women.

That's 5.6% per year, which would get you around 24.6% for four years. Actually a bit lower since some people would be victims twice, increasing the total number of incidents, but not number of victims, but still, pretty close to the 1 in 4 number.

But here's the problem: If you were raped 8 months earlier and given the survey, do you think you'd check the box saying you'd been raped in the last 6 months? There's two reasons why you might. First, you just didn't count the months. Kind of reasonable, I doubt many rape victims want to spend more time dwelling on that part of their lives. Second, a rape victim who realizes their attack falls outside of the time frame may still check the box out of a desire to have their experience counted. Again, I think this is pretty understandable, and I wouldn't blame the rape victims for problem with the stats. The blame would belong to the DoJ which should have foreseen how easily the stats can be skewed because of the small window.

If when they ask for 6 months, they actually get reports of rapes from the last 8 months, the incidence rate is increased by a third. If people report rapes 9 months back, it's increased by half. I really wouldn't be surprised if people reported rapes that were a year ago or even further back, meaning the reported rate may be twice the actual rate. The survey would be much better if it asked when the student started school, and if they had been a victim while enrolled there. Requires a little more math on the back end, but with Excel it's not really that tough.

My crim law book also discusses the famous study by Mary Koss that found 27% of college women had been raped since age 14. That's worse than the 1 in 4 number, though when you see "1 in 4 college women will be raped" it sounds like it means "during college" while the Koss data would include a lot of pre-college incidents. Here's the textbook's note on the Koss data:

One social scientist [Neil Gilbert] dismisses the Koss figures as unrealistic "[a]dvocacy numbers"; he notes that 73 percent of the women counted as rape victims did not label their own experience as "rape" and 42 percent of them subsequently dated and had sex again with their supposed attackers.

The common radfem response to women not considering the events to be rapes is that they've been socialized not to recognize that they've been attacked. I could see that happening with some girls getting really drunk, having sex, waking up the next day and blaming themselves and not thinking of the incident as rape. However, one of the definitions of rape Koss uses is "had intercourse when she didn't want to because a man gave her alcohol or drugs." That's really vague, and some of those women not labeling their experience as rape are probably right. And those 42% who hooked up again with their supposed attackers? I think we can be pretty certain that wasn't rape.

If the Koss study is limited just to the incidents where there was force or the threat of force, it drops from 27% to 9%. 1 in 11 is bad enough. Fluffing the numbers only makes you lose credibility.
