I like that it would require discovery and a right to face one’s accuser. I see no mention regarding standard of guilt however which needs changing.

The best way for students to have due process in my opinion is to have schools stop adjudicating cases of sexual assault and leave such alleged crimes to our criminal justice system. Colleges should educate, not adjudicate.

Using a throwaway account for this. But I’m a college student who is in the middle of a title IX case where I’m being falsely accused of rape and emotional abuse during a nearly 2 year long relationship. I broke up with her around 8 months ago and she’s decided to bring these charges now.

She has zero evidence other than her testimony, while I have multiple signed statements from witnesses the night of the alleged rape that make clear that I was actually the one pressured into a sexual situation by her that night, as well as texts that prove she asked for sex and constantly wanted to spend time with me multiple times for months and months after the alleged rape.

It’s a mess man. The investigation is an option for me where I can bring my evidence forward but otherwise, if I do the informal resolution, we have to negotiate back and forth on this dumbass list of her terms like “he can’t be in the vicinity of my dorm building” or “he can’t be in music ensembles anymore” even though im a music major lmao. It’s way easier to do the latter though, and I don’t wanna have to deal with this shit any longer.

Sure feels like I’m guilty till proven innocent, and I have had my name constantly slandered since we broke up across our small campus with false rumours. Meanwhile I have hardly said a word about the abusive way in which I myself was treated other than to one or two very close friends and my family, which is why I’m going to try and file a counter title IX case.

This article gives the false impression that the current mess was made by Trump.

The Biden administration is working to reverse policies that were established under the last administration and have been improving due process protections at colleges and universities.

My understanding is that Trump began trying to fix it but many US colleges ignored his directives and continued operating in accordance with the Obama standards, even though several court cases had effectively ruled them unlawful.

It is excellent news to hear legislators paying attention to the needs of men and boys on campus. Trump had a good start but what we need is legislation to protect due process for all college students.

Senator Kennedy is doing the right thing here. Good for him. I probably disagree with him on some other issues, but on this one he's absolutely in the right.
