This is shocking:

Ninetine US Senators signed a statement that "The harmful live hearing and cross-examination process. Which is wholly unnecessary to determine what happened in a particular incident..."

It is interesting that this only applies to students, whereas I have never heard calls to remove due process for non-students like these Senators.

Of course, without cross-examination, it might be hard to decide who is telling the truth. The Senators, seemingly aware of this, add "We ask that the Department outline additional safeguards on how colleges and universities make a credibility determination."

They are essentially asking the Department to abandon a bedrock principle of due process, the ability to confront your accuser, but were prescient enough to ask for a new, synthetic standard (that was evidently beyond their imagination or simply too unpalatable to put in writing).

That line advocating for University discplinary hearings not being quasi-legal was interesting.

"it ignores the educational purpose of school discipline"

I.E. It impedes the school's ability to make an example for how it handles its undesirables.

I'd just like to know what, in their minds, keeps those dastardly men from clogging up the system with bad-faith accusations, especially since presumably they'd all get preferential treatment from the patriarchy.

All 19 of the Senators that opposed due process where either Democrats or caucas with Democrats (Bernie Sanders).

Are elected Democratic U.S. Senators opposed to due process for college students as a party platform?

Is this evidence of systemic misandry withing the DNC?

Is there any research on alternative to real-time cross examination that also preserves the right to due process?

While I’m unapologetically pro-due process and the presumption of innocence, I’ve read enough about the psychology of rape [1] to be deeply sympathetic to how traditional court proceedings re-victimizes true rape victims and can involve intentionally or unintentionally using the way the experience of rape distorts and makes memory/behavior inconsistent to reject legitimate rape accusations.

On the other hand, I acknowledge and fear that these same issues around the reliability of memory/behavior can fuel false accusations of men, especially men of color or poor men.

It would be nice if left wing male advocates could advocate for court process research that makes proceedings more humane to true victims without eroding due process. To be fair, we, as men, must acknowledge that norms around due process were established when women had no voice, so it is very plausible that they are suboptimal.

The fundamental problem is feminists assume any accused man is automatically guilty and therefore any right he has to defend himself must be sexist.

In the UK we have a far more serious example of this, in actual law courts. There were miscarriages of justice because defendants weren't allowed to see information collection from their accusers mobile phone.

The data included texts and social media communications that either proved the sex was consensual or the rape allegation was false. Trials collapsed and men were found innocent as a result.

Response from feminists? They demanded that restrictions were placed on the ability of the defence to access such data. They completely ignored the fact the men in these cases were innocent.
