I’m getting so tired of the stalling. I left the house over 7 months ago because she wanted to keep it and the dog. Just need her to buy me out to get me off the deed/mortgage. Problem is I know she can’t afford to refinance. And the lender won’t let her take assumption until 90 days after final judgment which my lawyer highly suggested declining.

Been to court twice and each time I never even got in front of the judge. The lawyers went in, said there’s no agreement yet, ok see you in a couple months.

I have court again tomorrow and my lawyer has made it clear this has gone on long enough and he is filing a motion to have the house sold.

She’s put herself in a shitty spot just to get a few extra months with the house. We have 76k in equity that will be split, so why not just take it and go somewhere else?

I make twice as much as she does and even I’m struggling to pay the legal fees. My last monthly statement was almost $2000. She’s gotta be at rock bottom so why won’t she just throw the towel in?

Yes our marriage sucked but she’s just making things worse. I’ve been bending over backwards trying to let her find a way to keep the house.

We sent a final draft agreement over last week. Cut and dry, 50/50 equity split, plus a list of my stuff I need to retrieve from the house. She had an appraisal done about 2 months ago so that’s where the equity number is coming from. So how did she respond? She says I am to be capped at 38k equity and if she appraises the house again and it’s lower, I get half of the new equity. If it’s higher, she gets all the extra.

Nope. Not happening. I’ve been nothing but patient and courteous and she has fought me every step of the way.

I’m not vindictive but I can’t wait to see the look on her face when the judge approves the motion
