It's a horrible act that happened but the judge was correct, if anyone is upset, blame the child's parents. They're either terrible parents that don't pay attention to thier kid or don't care that their child is ready to become a slut.

It's tough to blame someone for committing a crime that they couldn't know.

It's the same reason as to why selling a hammer to someone who will use it to smash windows is not criminal, it's expected that you cannot know their intent and what they will do with what you sell them.

Here, in this case, the poor man can't reliably know the age of the girl, he has no crystal ball.

Judges typically rule in accordance with the law applicable to the jurisdiction in question. There’s no evidence given to suggest this judge ruled in contradiction to applicable law. Maybe he did, but without knowing what the legal burden was in the jurisdiction in question, there’s no reason to assume the judgement was incorrect.

I agree with the judge. His decision was based on, what a reasonable person would do.

I believe that an offence should not be constituted if a minor delibretely concealed the fact that he/she is underage, and/or actively deceived the major into believing that he/she is of consenting age, and that the major reasonably believed that the minor is of consenting age.

In fact, honest but mistaken belief is a defense in some jurisdictions such as the UK. This is one such case.

However, there is a limit. In the UK, for instance, one cannot rely on this defense if the minor is under 13.

What is the point of the law? To protect children from abuse, or to protect them from themselves? And how does holding the man accountable serve either function in this case?

It's easy to say, "11-year-olds shouldn't have sex," but age of consent has always been arbitrary and skewed high; even 100 years ago, girls got married by age 12 all the time.

At some point, this is nothing but moralistic hypocrisy.

I doubt an 11 year old can pass as a 16 year old, but I guess some reach puberty super early so it's not impossible. But if he truly had every reason to believe she was of age, then it's not his fault and the ruling was right.

Nah, this ain’t it.

You are responsible for knowing the age of the person you are having sex with. If you get tricked by an 11 year old, that’s on you. Holy shit has anyone here ever had a conversation with an 11 year old? It’s not similar to having a conversation with an adult. They do not have the legal authority to consent to sex with an adult, point stop.

If you’re speeding and your defense is “I didn’t know that was the speed limit” it does not invalidate the crime, it’s your responsibility to have consent before your sexual encounters. If the person you are penetrating is 11, you didn’t have consent.

I don’t think I could give the guy the benefit of the doubt in this case; I don’t think the judge was correct.

She was within a 16+ space and he still felt the need to ask her for an ID. That means he obviously felt something was off about her age.

The fact that he asked for her ID within a venue where she was already supposedly verified to be at least 16 to enter, makes me think he knew she was younger than she said. It makes me think he knew she was too young to be there and was actually trying to establish plausible deniability in an effort to cover his ass.
