You're fine. If there are adequate sleeping arrangements and it's a safe living space, the burden is on your ex to somehow demonstrate that it's not a suitable space.

Don't think you have to hold some impossible standard of separate rooms and unaffordable apartments. These are artificial roadblocks your ex and her lawyer will use to discourage you, and that's not the spirit or the language in a custody order.

The court will never keep your kids away from you because you can't afford a larger apartment. Family court cannot order you to rent an apartment you can't afford. It's all posturing and virtue shaming; nothing in family court or child protective services can punish you for having a small apartment. Don't address your ex's objections. Let her try and take you to court over it. You're not doing anything wrong by getting the space you can afford while you're getting back on your feet.

"Adequate sleeping arrangements" means having a bed in a protected, covered space, the house has escape routes, there aren't any electrical / structural / chemical dangers. You can have an inflatable mattress or a sofa bed or one of those fold-out foam things we had in the 80s.

With rent rates skyrocketing nationwide and if I have been hearing right the same for our cousins across the pond sometimes it's the best you can do. A apartment I rented last year for 1180 is now 1600 a month. people are simply getting priced out of the market. That being said anything on the kids end starts getting wonky. Kid acting out more, wanting to be with the other parent. The court then may choose to award more custody to the mother. Its rough right now try and hang in there.

Don't over stress it. I share a large 1 bedroom with my 7 year old daughter. I'm paying $1700 and a two bedroom in my shitty old complex is $3200. I simply can't afford it. For now it's fine and it makes her feel safe to be with me. However when the time comes I'm putting a Murphy bed in the living room and she can have the bedroom.

If there’s any way you can swing a 2BR, you should do it.

If you are forced to get into a 1BR please make a realistic game plan to get out of there within 18 months.

It will be important that your growing boy sees your dwelling as a home. Just not going to happen in a 1BR.

Sorry you’re in this spot brother. Claw your way out and improve your life. Start diligently thinking of ways to make it happen. You can do it!!
