I have been served no papers yet. I have been a stay at home dad since march for my now 11 month old daughter. I stopped going to college in order to let my wife capitalize on a job offer. She makes roughly 50k while I make roughly 12k off of veterans disability. She expressed she wanted 50/50 everything and would wait for me to get a full time job before finalizing the divorce, all amicable until she threatened to literally get fired and bring us to foreclosure on our house if I asked for alimony or child support. (This stemmed from me asking her about an increase in salary promotion she received at the time she informed me of wanting divorce.) She was VERY verbally and physically abusive in this confrontation and I had to walk across the street to a neighbors with my child for fear of both of our safety. She called the cops b/c she didn't know where I took her and they stated nothing I did was illegal but that I should stay somewhere and take money out( she struck before I had a chance, see below) She has many bees buzzing in her ear to try and crush me in court, family and work friends, but she said she was "graciously" trying to be amicable. Also she cut me off of our joint account but not before transferring almost all of my disability paycheck into hers, citing "she doesn't trust me to pay the bills", while refusing me to even be allowed to see what transactions are going on in that account. I am searching for the best lawyer I can get in my area, if only to protect myself, but I have an opportunity coming up I am unsure whether to capitalize on. In a week she will be leaving for a week long business trip to California, and am wondering should I try and blindside her with papers served and try and get temporary orders for staying in the house and custody and temp alimony (to survive)? She has both parents with available housing for her to stay, and also her parents (both six figure salaries) will front her legal fees if this gets ugly. I have no family close and now limited financial access. I think she is feeding me bullshit until she is ready to strike on her own, but do I dare kicked the hornets nest while it is sleeping?
